Call the Bailiffs Time to Pay Up S02E06 (31 August 2022)
Transcript
00:00We're High Court enforcement agents, we've got a High Court here, I'd like to sort this out face to face.
00:06Peace out!
00:07£12 billion is owed to people and businesses in the UK.
00:11Don't do that, sir!
00:12There is money owed, and it has to be paid.
00:15When all other attempts to settle a debt have failed.
00:18This is quite a lot of money, it's over £5,000.
00:20Can you come to the bill please?
00:21Cases can end up at the High Court.
00:23Nothing can conquer the writ.
00:25Where a judgement commands enforcement officers to recover what's owed.
00:29Our agents are a last chance saloon.
00:31Let's go!
00:32A High Court writ.
00:33All check-in debts are going to be closed until this match is resolved.
00:36Gives agents the authority to enter unlocked homes and businesses.
00:40We've made contact, we know they're there.
00:42We're forced an agent!
00:44Everybody leads the trail.
00:45And to seize and sell property.
00:47If you think we're doing something illegal, call the police.
00:49They're trying to do everything they can apart from actually paying the bill.
00:52To finally get debts paid.
00:53They want us to get their money back.
00:55£56,000.76 pence outstanding.
00:58In these difficult times.
01:00I need to go on.
01:01Agents find ways for people to clear their debts.
01:04We're not ogres, we're nice people.
01:06Hopefully it'll be a weight of your shoulders then.
01:08But every day.
01:09Call the police now.
01:10They face aggression.
01:11You wanna fight me?
01:12Don't do this again!
01:13And abuse.
01:14Get out of my way!
01:15As they try to settle debts.
01:18Watch your back Chris!
01:19This is £70,000 here.
01:20That no one else can.
01:21He thinks he can fight me.
01:22I don't think.
01:23I know.
01:24What do I do?
01:37That road go right around?
01:38This is actually the east.
01:40So we wanna go right around to the west there.
01:43Agents Chris and Sam are on their way to one of the most famous stately homes in England.
01:50To try and recover a debt of over £17,000.
01:55Have you ever done anything like this?
01:57No.
01:58Dealt with some very wealthy people.
02:01Nothing like this.
02:04Built in 1705, Lennon Palace is a residential property and a popular visitor attraction.
02:15Lovely building here, very grand.
02:20That is beautiful.
02:22Yep.
02:23It's amazing.
02:27The money is owed by the 12th Duke of Marlborough.
02:30For work done by a solicitor.
02:32Who's had to go to court to try and recover fees that haven't been paid.
02:36The bill has been outstanding for over a year.
02:40Hello.
02:41My name's Chris.
02:42I'm an enforcement agent.
02:44Issued with a high court writ.
02:45Obviously we're gonna talk to the Duke direct about this.
02:49It's not often when we get told I will call his butler and his butler would know what's going on.
02:55Yeah.
02:58Chris and Sam have the authority to seize property to try and recover the debt.
03:03But as the writ is in the Duke's name, the agents can only take possession of assets that they reasonably believe are owned by him.
03:10So in relation to the Duke, obviously he's not here right now, but his apartment is just the other side of the buildings.
03:20Is there any other relatives or is the butler at the building?
03:23Um, we're just trying to find various people.
03:29That might clear the debt.
03:30That's under the trust.
03:31There it is.
03:32Oh yeah.
03:33Do you know roughly how long it'll be?
03:35I'll just go have a chat with her.
03:36Yeah.
03:37Lovely.
03:38Sam and Chris have information that the Duke has private apartments in one of the wings of the building.
03:44As they wait to be put in contact with him, they are shown a letter from lawyers for the Blenheim Palace Foundation charity about the Duke's ownership of property at the palace.
03:57It's carved out all the builders that they're in.
04:00So it's trying to say a blanket thing here that he doesn't have any personal items at this property.
04:05That's not entirely correct because we do know he's got an apartment here, which will have assets.
04:21What do you think?
04:22It's going to be a five minute job, with my eyes, or two, three hours job.
04:27Agents Mark and Virgil are looking to settle a debt owed by a pizza restaurant to one of its suppliers.
04:33It's from a company, a cheese provider.
04:36Obviously, you've got to have a cheese provider if you've got a pizza place, don't you?
04:40Yeah.
04:42The restaurant owes just over £4,000.
04:46It's a lot of cheese.
04:48Yeah, but I'm guessing it's not just for a month.
04:51Saying that, yeah, it's a pizza place.
04:53If you do 100 pizzas a day, that's just going to be your monthly bill.
04:57The cheese supplier tried for months to get the money back before turning to the courts.
05:02That's nice.
05:05The claim can be anyone.
05:06Businesses.
05:07It can be people.
05:09It's someone who's made a bad decision, picked the wrong business to deal with, or engaged with the wrong person.
05:15It could be anyone.
05:16It could be you tomorrow.
05:17You're like a hair out of bloody traps.
05:18Can we speak to somebody that's in charge of Ascot Pizza?
05:31Yeah, I'm going to...
05:32Oh, perfect.
05:33So, basically, we have a high court rate.
05:34Yeah.
05:35I'm guessing it's for mozzarella bill or pizza bill or cheese bill.
05:36Yeah.
05:37Something like that.
05:38Yeah.
05:39Okay.
05:40They went to court.
05:41They obtained a county court judgment, which then they escalated to the high court.
05:46Currently, the amount to pay is £4,099.87.
05:51If it can be paid in the next 20 minutes, see?
05:54And after another 30 minutes, if it's not paid, we're going to be removing items from this property.
06:04Okay.
06:05I'm going to call the owner.
06:06That's perfect.
06:12I've just spoken to the owner.
06:13So, we're PRG Ascot.
06:15Okay.
06:16We're not Ascot Pizza Project.
06:19And this is not with us.
06:21It's with the old company.
06:23Although operating from the same building, the manager claims the debt is owed by the
06:29previous occupiers.
06:30Yeah.
06:31That's the old company.
06:32Yeah.
06:33That's the old company.
06:34Yeah.
06:35It's been dissolved.
06:40The most important thing when you're talking to somebody is body language because that gives
06:46you a better comprehension of what you're going to do next and how you're going to handle
06:49the conversation moving forward.
06:51Is there any chance you can call the owner?
06:55Yeah.
06:56Basically, I need the tenancy agreement and the business rate.
07:00Because that will show, obviously, who's here.
07:02Sure.
07:03Sure.
07:04If the company can't prove they're not the one named on the writ...
07:09Do you have any public indemnity or public liability insurance stamped on any wall?
07:16The agents will attempt to get payment today.
07:21Or a hygiene thingy.
07:23Because it would have a name there, wouldn't it?
07:26Do you have what hygiene costs?
07:29No.
07:30No.
07:31No.
07:32No.
07:33No.
07:34No.
07:35No.
07:36No.
07:37No.
07:38No.
07:39Chris and Sam search for assets.
07:40If the payment isn't landed, I will then be looking at physically removing items.
07:44And Mark and Virgil.
07:45Thank God.
07:46Virgil.
07:47Yeah.
07:48Chase for payment.
07:49Oh my God.
07:50Mark and Virgil are waiting for a pizza restaurant to prove they do not owe over £4,000 to a supplier.
08:17They want a tenancy agreement.
08:18Yeah.
08:19They want...
08:20Business rates.
08:21Business rates.
08:22Insurances.
08:23That's it.
08:24And insurance.
08:25That's...
08:26Imagine your alcohol license would be downstairs, wouldn't it?
08:27They won't take invoices.
08:28To have an alcohol license, you've got to have your tenancy agreement on site, so you should
08:41be quite used to get a hold of it.
08:44It is really hard because you're dealing with people and when it comes to money and debt
08:49in these kind of times that we are living in, it's really, really hard.
08:53First of all, because a lot of people, because of the pandemic, have it really hard.
08:59But also because a lot of people have got into a habit of avoiding it until now.
09:05How long have you been here?
09:07Basically, how long has the company been here?
09:10To be honest, I have no idea because I wasn't here.
09:12No, no, no.
09:13Generally, I have no idea because I wasn't here when they opened.
09:15So, I know it was under previous ownership and it changed hands.
09:19Sometimes, I think, the backhand of our CEO early this year.
09:22And they will have all the documentation and they can always let you see what was what
09:27and when decided and so forth.
09:29As long as we have documentation, we don't got a problem, you know?
09:32Yeah, yeah, yeah.
09:33He's saying that if we take an email address and we'll send it all through to you.
09:36We need to really see it today, now.
09:39They need to see it now.
09:41Oh, I'm going to find the alcohol license.
09:46It's the next time.
09:51What about your alcohol license?
09:52License?
09:53Alcohol.
09:54Sure, yeah.
09:55Of course.
09:59Got it outside?
10:00I can't.
10:02It's usually inside.
10:04Okay, cool.
10:05All right, please.
10:09Hopefully, that's one.
10:10If you've got alcohol.
10:11Oh, yeah.
10:12No, there is.
10:13There is.
10:14Because they come and check the admission.
10:15I just don't know what else.
10:20The obvious documentation.
10:21You've got to have the alcohol.
10:23It's got to be at hand.
10:26You've got to have a tenancy agreement as well.
10:27It's got to be on hand.
10:28But it's just not.
10:36As the manager searches.
10:37Ooh.
10:38It's the old one.
10:39So you're telling me this one isn't valid then?
10:40Yeah.
10:41So it's not valid.
10:42So there's no point in showing it to me, really.
10:44The only documentation provided is out of date.
10:49Definitely something here.
10:50We need the paperwork.
10:51The other quicker option.
10:52If you know who does have it.
10:53Get them on the phone and get them to pay it.
10:54Save us being a fraud on your side.
10:55While Virgil continues to hunt for paperwork upstairs.
10:58Downstairs, Mark makes a discovery.
11:04Bingo.
11:05Virgil.
11:06Yeah.
11:07Oh my God.
11:08Right, what's the following up?
11:09Yeah.
11:10We're all downstairs, yeah.
11:11They left everything, couldn't they?
11:12They left all their paperwork?
11:13Yeah, they literally left everything.
11:14To that indicate we need to see, burn the proof of all the assets who they belong to.
11:35Despite finding all the invoices relating to the debt, the manager still claims the current restaurant is not connected to the one named on the writ.
11:46I'm going to warn off the office for removal.
11:48Yeah.
11:49This corridor is historically known as the Duke Passage.
12:02This door was coming up to his.
12:04If he was here, he'd go in that door.
12:06Chris and Sam are looking for the personal possessions of the Duke of Marlborough.
12:11So I'm guessing this is the grand entrance for, if he had a car, drive him in.
12:15Who owes a bill of over £17,000 to a solicitor, who hasn't been paid their fees.
12:22So this would be the front door?
12:24Front door.
12:25Oh, OK.
12:26Unable to make direct contact with the Duke, they've started trying to identify his property.
12:32So this is obviously his, his space.
12:35That's his private space, I'm guessing.
12:36No, no, it's open to the public.
12:37Oh, OK.
12:38So the possessions all belong to the charity?
12:40Yeah.
12:41A charitable trust controls a lot of the property at Blenheim Palace.
12:48So the agents need to work out which of the Duke's assets could be seized and sold to pay the debt.
12:54These are our business premises.
12:57Yeah.
12:58And our lawyers are saying there is nothing here of the Duke's and I know that is true.
13:02Is there a fucking space that Duke has?
13:07His PA is not around today.
13:10Yeah.
13:11Has a space somewhere there and it doesn't attain interesting things.
13:14Yeah.
13:15OK.
13:16Can we get hold of her on the phone?
13:17Because she might have a way of directly speaking to him.
13:19We've, we've been calling his PA and the Duke.
13:22We must be able to get her, especially in an emergency.
13:25We, we've called one.
13:26We, we, we keep calling for the state.
13:28Please.
13:29What you said to me is obviously there's, there's an office space that she has, um, which is
13:33obviously his, his space that he obviously gives to her.
13:36Because it's a commercial space as such, um, and not a residential space as we were first
13:42thought, we can actually use a locksmith to gain access to that property.
13:46As we are high court enforcement on commercial properties, we can use a locksmith to enter.
13:53To have that ability is a huge game changer for us because once we're inside, we're not
13:58saying, look, you need to pay your debt or else.
14:01We can actually show them that if it's, it's not getting paid right now, we are taking these
14:05items out.
14:06As Chris and Sam prepare to organize a locksmith.
14:11They get a call from a friend of the Duke who has been asked to intervene.
14:21At this stage, when we're issued a high court writ, we're instructed and commanded to take
14:25control of goods, um, there and then to, to try and close off that debt.
14:29The friend says that the Duke does know the firm of solicitors that's owed the money,
14:34but believes there's been some kind of mistake about the debt.
14:38What we are going to do though is because I believe they're going to refuse to give us
14:41access.
14:42So it means after half past two, if the payment isn't landed, I will then be looking at physically
14:46removing items.
14:53Chris sets a deadline for the Duke to make a payment.
14:56But in the meantime, he wants to make sure there aren't more assets belonging to him on
15:01the grounds.
15:02Does it feel like you're making progress?
15:04I said, I won't trigger until 2.30.
15:07So we'll have a look around the, the, the, the grounds.
15:10I'm not going to remove, um, anything unless I see a vehicle.
15:13It's like a, you know, something really obvious.
15:15That's his car.
15:16But we will then look at some other items that potentially could be here.
15:19So it might be a bit of an art piece or something like that.
15:21And I'll, on paper, I'll be taking the control of it.
15:24And I was going to say, we can have a look at where the cars...
15:27The point where you want me to go?
15:28Yeah, where the, where the, the, the cars are.
15:31The chief executive of the palace charity shows the agents around the property.
15:36This genuinely was the Blanton fire engine.
15:38It was donated back to us by the oxygen fire brigade.
15:41I certainly prefer the cases which are very open and closed cases.
15:45However, sometimes there's cases where you've got to really dig in, investigate, go through things.
15:52I could, if someone opened that, you would see a lot of retail stores and things like that guidebook.
15:55So there's no Rolls-Royce's, Bentley's.
15:58Ah, there you go.
15:59That's what I can see inside, actually.
16:01Yeah.
16:02This is car parking.
16:03There will be some estate vehicles here.
16:04That black vanage estate vehicle, the two different things are.
16:08So where would, where would he park if he was working?
16:11If he came?
16:12Where he went to the door and said this is his front door.
16:14Yeah, yeah.
16:15On the, on, just at the bottom of the steps there, he'd have a Range Rover.
16:19I really just stumped there.
16:20Okay, fair enough.
16:21With no obvious assets on site and the deadline approaching.
16:26Let's give him another call.
16:28Chris calls the Duke's friend back.
16:30I'm just about to turn that thing.
16:36The man says that he believes the Duke is disputing the debt and doesn't know whether he would agree to pay it.
16:43Okay, it's just, uh, I'm watching this time and it's hours since, um, since we actually got here.
16:50With no progress, the agents may be forced to take further action.
16:55I always stick to my word, but 2.30 would be the, the mark where I will be making a phone call to take control of goods.
17:04Mark and Virgil have made a breakthrough looking for evidence linking a pizza restaurant to a writ for 4,000 pounds owed to a cheese supplier.
17:21It could be something trading as Ascot pizza.
17:26That's what it looks like to me.
17:27Yeah, yeah, yeah.
17:28Yeah, I'm happy with this.
17:29With this.
17:30I'm, I'm very happy.
17:31I've got no problem moving forward.
17:35The agents now believe they can remove property from the premises to help cover the debt.
17:40About 500 pounds a time.
17:43I know.
17:44If each one of those is 500 pounds.
17:45You can see why.
17:46It's not even a year, is it?
17:48It's just a couple of months.
17:49So, yeah, I'm happy with this, mate.
17:52It doesn't really get better than this when it comes to proof.
17:55So, in court, I'm more than happy.
17:57More than happy.
17:58The manager gets the owner back on the phone.
18:04He doesn't want to lose any of his stuff because we really need to keep.
18:07I understand.
18:08So, he's just going to pay it and then we'll fight it all out.
18:11Yeah.
18:12Yeah.
18:13When it's held for 14 days, yeah.
18:14Okay.
18:15Cool.
18:16Let's go on.
18:17The plan is when we turn up at a property is to get payment in full.
18:21That's what we do.
18:22If you want any scenarios, you always see the debtor's point of view, but you do not take in consideration
18:27the claimant's point of view, the amount of stress that he has taken on due to this money owed.
18:34We've got to represent the claimant to get the money.
18:37He's transferred it into my account.
18:38Yeah.
18:39I can transfer it to you.
18:40Yeah.
18:41But it's not clearing.
18:42The amount is not...
18:43Like, it won't clear for me to transfer it on.
18:44Why didn't he transfer it?
18:45I...
18:46I think I...
18:47I don't know.
18:48Because that could take two hours.
18:49That could take two hours.
18:50That could take two hours.
18:51So they said they're going to pay.
18:52And I'm hoping it's now just a stall tactic.
18:55Look, we'll do this.
18:56So it's 25 past one.
18:57We'll give another 15 minutes.
18:58If it's not paid, we will have to go to the removal stage, which will increase the amount,
19:03and obviously, we'll have to remove, which we don't want to do.
19:07Okay?
19:08Well, I think this is fair.
19:10So she's got the money.
19:11She's just having issues.
19:12When you said 15 minutes, can you just give us more time?
19:17The money's 100% there.
19:19If she can't get it via transfer to you, I'm going to ask you, just give us a little bit
19:24more time.
19:25No.
19:26No.
19:27No.
19:28No.
19:29No.
19:30No.
19:31No.
19:32No.
19:33No.
19:34No.
19:35No.
19:36No.
19:37No.
19:38No.
19:39No.
19:40I'm gonna take or we get the cash, I will give it to you.
19:42Just honestly, the money is there.
19:46I think it's got so good.
19:48I think you can get so good.
19:49Oh, it's got so good, perfect.
19:52Are we cleared?
19:53Yeah.
19:54Oh, perfect.
19:56Perfect.
20:02You all right?
20:02Yep.
20:04Could we confirm the payment, please?
20:07OK, pretty.
20:08Give me literally two seconds, and I'll get back as a check, please.
20:15Hi, sir, we've received 4,594.
20:18Thank you very so much.
20:20We've showed you the receipt.
20:22An hour after they first arrived, the payment is safely in the bank.
20:28This is why we do our job.
20:31It's cases like this that make it worthwhile.
20:33Very good result on this one.
20:34Very good result.
20:36We are good, separate, but when we're together, unstoppable.
20:40We are.
20:41We are unstoppable.
20:42So...
20:43Just pay your flipping cheese bill.
20:45Yes.
20:47The restaurant later complained that they shouldn't have had to pay the debt.
20:55But the cheese supplier got their money back.
20:57Coming up...
20:58The duke is sake, it's not just dash.
21:08Chris and Sam dig their heels in.
21:10I always stick to my word.
21:11At Blenheim Palace.
21:12I will be making a phone call to take control of goods.
21:15Sherry and David.
21:17Please don't tell me what I can and what I can't do.
21:19Deal with a debtor in denial.
21:21I'm not owning this one, you're true.
21:23And Mark and Virgil.
21:27Sir, because you promised so many times and you didn't deliver.
21:30Yep.
21:31It needs to be paid now, sir.
21:33Are in pursuit of £20,000.
21:35Oh, sir, the payment won't be crying.
21:38With the cost of living rising, debt is becoming a greater problem for everyone.
21:54Hello there, can you come to the door, please?
21:56With the average total debt of a UK household nearly £64,000.
22:02We've just got high call rates saying that we need to remove assets.
22:06But not everyone in debt is facing financial difficulty.
22:10Erm, who's the boss?
22:12You're the boss?
22:13Yeah, perfect.
22:14And the courts and the agents who enforce on their behalf.
22:17Has a bit of a sound.
22:19Treat everyone equally.
22:21Unless we receive this money by payment today, we'll be looking at seizing the Bentley, for
22:26example.
22:27Hello.
22:28Hi, Mark.
22:29It's Sue.
22:30Mark and Virgil are on their way to see someone they've dealt with before.
22:31We have a writ, which was on a payment plan, which has now been defaulted on.
22:49So, we've got a big one.
22:50He's a very civilised man.
22:51Is he?
22:52Yeah, very civilised.
22:53Very, very smart guy.
22:54He is the director of a £4 billion company.
23:09The agents are making their second visit to a man who owes thousands of pounds for unpaid
23:14rent on a property.
23:16Basically, the total was almost 40k.
23:22After I went there, he made an arrangement.
23:25The first £10,000 was paid in October, and then the next £10,000 was paid in January.
23:32And he was promising to pay, I'll pay, I'll pay, I'll pay, and he hasn't.
23:37The man owed the money has been trying to get it back for over seven months.
23:43This is humongous, and it goes down as well, that looks like.
23:48Yeah?
23:49Yeah.
23:50The door is open.
23:59Hello there, my name is Virgil, I'm a High Court enforcement agent.
24:11An unfamiliar face comes to the door.
24:13Where's the missus or the mister?
24:15Can you call them now so they can come here?
24:17If they don't get payment, the BMW on the driveway could potentially be seized by the agents to
24:25help settle the debt.
24:26Car is blocked in.
24:27Anything in the garage?
24:28Yeah, that's it.
24:29OK.
24:30I'll have a look at the car.
24:31Yeah, yeah, yeah.
24:32Hello?
24:33Yeah, hello.
24:34Hello.
24:35My name is Virgil, I spoke to you last year, I came to this property, it's in regards
24:44to the debt.
24:45You remember?
24:46I've done 20,000 already.
24:48Sir, because you promised so many times and you didn't deliver, it needs to be paid now,
24:54sir.
24:55If you've got the money, that's our job is to find out where it is and how can we extract
25:00out of them.
25:01Once you find out, then we will start pressing on that pressure point.
25:06Sir, you need to do a transfer.
25:07It's the same way as you've done last time.
25:09No, no, no.
25:10No, I can't do transfer because it's from the US into your account, so it has to be over
25:17the phone.
25:18Are you able to take payments over the phone?
25:21Yeah, I'm able.
25:22It's not a problem.
25:23OK.
25:24I can do 10,000 right now using my card.
25:27OK.
25:28I can only authorize 10,000 today and I'll do another 10,000 tomorrow.
25:33Obviously, going through a person's house, you can clearly see whether, you know, they're
25:37rolling in money.
25:38And from our point of view, that's how we start the negotiation.
25:41We see, OK, do they have?
25:43Don't they have?
25:44No, if you do 10,000 now from one card, you need to find another one.
25:49You're going to do another 10,000.
25:50It needs to be the full, another 9,000.
25:52It needs to be the full amount.
25:54No, I can't, my limit is 10,000.
25:57I'm sorry, sir, but in seven months, you had more than enough time.
26:01That's fine.
26:03Let me call the card over the phone.
26:06You charge 9,000 and then I'll call my bank.
26:09OK.
26:10Let me call my office so they can take the debit card.
26:12All right?
26:13When people say, I can't pay this week, I'll pay next week or I'll pay double the other
26:18week, it's one thing when, you know, it's genuine.
26:22Thank you for calling.
26:23Can I help you?
26:24Yeah.
26:25I have the gentleman here on the phone.
26:26Can you pass him the bank details?
26:27When it's not, you just have to make sure they pay the amount.
26:32OK.
26:33Are my card details?
26:34Yeah.
26:35I need it.
26:36It's probably there too.
26:38Payment is done, sir.
26:41So it has been, payment has been approved?
26:44Yes, it's been done.
26:46OK.
26:47Thank you very much, sir.
26:48So the rest of it is 9,044 pounds and 73 pence.
26:53OK.
26:54Charge the same card, the same amount.
26:57OK.
26:58Hello, mate.
26:59It's me again.
27:00Can we do the rest on the same card details and everything?
27:04I'm going to pass it over.
27:05You can speak with my colleague.
27:07You are paying 9,044 pounds and 73 pence straight.
27:13Yes, please take it down.
27:15Thank you, sir.
27:16Just one second.
27:17Oh, it said the payment got declined.
27:20It says declined by the time.
27:22No, one second.
27:23Let me see.
27:24OK.
27:25Patience is key in this game, especially with the larger debts.
27:29Give me a minute to call my bank.
27:30I'll call the bank.
27:31But I'm too battle-hardened.
27:32We are there to enforce it.
27:33It's never the right time.
27:34Tomorrow never comes in this job.
27:35It's always today.
27:36If the man can't pay off the rest of the debt today, Virgil and Mark will look to settle
27:40the bill by seizing goods from the property.
27:41Chris and Sam are preparing to seize assets from the Duke of Marlborough.
27:452.30 would be the mark where I will be making that phone call.
28:13With the Duke's friend unable to help get a payment.
28:17I always stick to my word.
28:20The agents continue to talk with the chief executive of the Blenheim Palace charity.
28:24If there's a way that we can have a look at that room, I can't agree to that.
28:30Sadly, a lot of time is the case of that person is someone who's trying to, you know,
28:35avoid dealing with the matter.
28:37And that's when you normally start putting a bit of pressure on.
28:40With no easy access to the Duke's office, they may need to force entry to execute the
28:46writ.
28:47If we can get access to that, that would be great.
28:50Agents can take control of property they reasonably believe belongs to the person named on the
29:03writ.
29:04Once it's seized, there's still time for any third party claims to ownership of the goods,
29:09before anything is sold.
29:11I'm just trying to work out to any other way I can get permission to arrange payments.
29:16And I don't think there is, but...
29:17Oh, yeah.
29:18I could if the trustee agreed and the Duke agreed.
29:22Yeah.
29:23And I think the sticky point is the Duke is saying it's not his debt.
29:26I just don't have to do the work and I'm going to give it a try.
29:30Chris and Sam wait to see if the Chief Executive's attempts to organise a payment through the trustees
29:36is possible.
29:37To do this job, you need to have patience.
29:40There are many jobs that you'll be sitting on and you could be on that job for a good
29:43few hours.
29:44It could be because they're trying to mislead you.
29:47It could be a case of it's that company's processes.
29:50So you've got to look at every case in its own merit.
29:54Was there any update?
29:57We're one step forward.
29:58Okay.
29:59If the Duke will accept that it's his debt in writing to me, it's what we sold.
30:05Yep.
30:06Then I have the trustee's authority to pay you.
30:09Okay.
30:10They're saying you can't authorise me to pay you.
30:12If he doesn't give back that authorisation, it's not our money.
30:17Okay, that sounds fair.
30:18You've got to be stubborn.
30:20You know, there's a lot of people which will just try and wear you down.
30:25So you have to stick in there, keep going through the motions and then identify if they
30:30can pay or if you need to work with that person more.
30:33So one of the Duke's advisors is trying to persuade the Duke to even text or email me
30:41that he's happy.
30:42Okay.
30:44Hopefully we're going to have a success.
30:46And it's not long before they get his official response.
30:51Last slide.
30:53Please pay with my agreement.
30:55Oh my goodness.
30:56It'd be bank transfer, but I'm not going to get you a copy of the accommodation.
31:03As long as it's paid, it clears his name and it clears up the case.
31:06I'll be walking back to your van and wishing well.
31:11Lovely to meet you.
31:12You know, it has been lovely being here.
31:14Excellent.
31:15That's it.
31:16Hurry back.
31:17No.
31:18No.
31:20All the best.
31:21Very different job, but still.
31:23Very different.
31:24But the thing is, you know, when he realised he needed to pay, he did pay.
31:28To start off with, he didn't think he was liable for the debt.
31:30But luckily his financial advisor, you know, advised him that if your name is on a writ, no
31:35matter who you are, you're going to need to pay it or see your assets go.
31:50When you do this job, you need a break.
31:53You do need a break from the job.
31:55Any idea where you'd like to go?
31:58Caribbean or somewhere like that.
32:00Yeah.
32:01Yeah.
32:02Yeah.
32:03David and Sherry are on their way to recover a debt from a business that owes over £1,500
32:16in fees to an international money transfer company.
32:21This kind of debt is where our client has fulfilled the money transfer but not
32:29is not being paid by the third party.
32:32We're going to proceed with issuing a writ of control and getting our agents to attend.
32:36Ready?
32:37Yeah.
32:38The shop is the registered address for the company that owes the debt.
32:45Hiya.
32:46Are you the manager or director of the shop?
32:49Manager.
32:50Are you the manager?
32:51No, no, I'm the manager.
32:52You're the former manager?
32:53Yeah.
32:54Is that him?
32:55Yes.
32:56At the top.
32:57The shop assistant puts the agents in contact with who they believe is the director of the
33:04company.
33:05Hello.
33:06Hello.
33:07Hey, what is me and my colleague, Sherry, we're enforcement agents.
33:10We've got a high court rate for this address.
33:13What's the reason to be committed in the shop?
33:15It's for debt.
33:16High court rate.
33:17The problem is I've sold the business.
33:20You're telling me that you sold the business.
33:23I sold the business.
33:24We need to see the proof.
33:25Which proof?
33:26This guy.
33:27Right.
33:28When you sell stuff, you'll have a bill of sale or some sort of contract that you're selling
33:31the business too.
33:32That's the problem.
33:33The guy that I'm sold the business, okay, he's back to his country, Romania.
33:40So you ain't got no proof that you sold the business?
33:42The problem is I can do it, but I'm not in the home.
33:46Even because I'm out of the Birmingham.
33:48If I'm at home, at least I can give you some papers.
33:51That's the problem.
33:52I'm not sure I can't prove it, I can't.
33:55David and Sherry need to establish if the shop is still part of the company that the
34:07director is saying he sold.
34:09If it is, they could seize stock to help pay the debt.
34:14I'll pass you on to my colleague.
34:17Hello, Sarah.
34:19Right.
34:20When did you sell it?
34:21In January I sell it, January.
34:23January what?
34:25January 2021.
34:28Despite the man insisting that he sold his company, records show he's listed as the only
34:34director.
34:35Are you the director of the company?
34:38Yes.
34:39Okay.
34:40So we've established that.
34:42You are still the director, aren't you?
34:45Yes.
34:46Yeah.
34:47So you need to pay this.
34:49You've already had written notice of this.
34:52There's been...
34:53I swear to God I've not seen nothing.
34:55Sherry.
34:56Sherry.
34:57Searching behind the counter, David finds opened letters addressed to the company that
35:02suggest it's still connected to the shop.
35:05I'm trying to explain to you because time is ticking.
35:08If you don't pay or get somebody to help you to pay this, we're either going to close
35:14the shop or we're going to remove goods to the value of that debt.
35:19You've got now about 15, 20 minutes.
35:22Okay?
35:23But you can't move these people.
35:24No.
35:25Please don't tell me what I can and what I can't do.
35:27Mom.
35:28I'm here with the high corporate.
35:29You're so hard.
35:30Okay.
35:31I'm going to...
35:32No.
35:33I've said it to you clearly.
35:34I'm going to terminate the call now.
35:37Bye-bye.
35:38If you think somebody is pulling a fast one and they're playing the system and playing
35:45the game, it comes down to who's going to back down first.
35:49And you know you've done background checks.
35:51You can show them proof that they're still trading and they're saying, no, they don't.
35:56It's more than frustrating.
35:58That's all we need.
36:0122nd of March.
36:03The date is the 2nd of March, 22.
36:06If you sold the business in January, would they still be here?
36:10He's got a county court claim form.
36:13This is all proof that the company is still here and still trading us, isn't it?
36:19That just doesn't add up to me.
36:21That proves the business is still working for me.
36:24So now the owner needs to come up with the cash.
36:31Coming up...
36:33Mark and Virgil...
36:35This isn't a great situation.
36:37...close in on unpaid rent.
36:39Then we'll have to look at other avenues to get the money.
36:42...and David and Sherry raise the stakes.
36:44You don't need to swear at me.
36:48We could take this further.
36:50Mark and Virgil are trying to get a final payment of £9,000 from a man that owes the money for unpaid rent on a property.
37:15I'll call you back.
37:16I'll call you back.
37:17Okay, so give us a call back, okay?
37:19The person that's owed the money has been trying to get the debt paid for seven months.
37:24He's paid £10,000.
37:25Still went for the £9,000.
37:28But the debtor has hit the payment limit on their card.
37:31What we tend to forget, £19,000 is someone's yearly wage we're asking for in 30 minutes.
37:40Hello?
37:41I'm on hold with the bank so you give me a moment.
37:46Yeah, no worries, sir.
37:47No worries, sir.
37:48Thank you very much for calling.
37:49Let me know.
37:53Mark and Virgil have the authority to seize assets that can be sold to recover the debt if they don't get the payment.
38:01This isn't a great situation.
38:02He isn't here.
38:03His wife isn't here.
38:04Hence why we're here, hoping that'll be enough to gain payment.
38:07If it isn't, then we'll have to look at other avenues to get the money, which might be us entering the house.
38:15With the agents ready to take further action, the man calls back.
38:21The bank says it should go through now, so let's try again.
38:26Let me get in touch with my colleague.
38:28One second, please.
38:32Hi there.
38:33My name is Virgil.
38:34I'm an enforcement agent.
38:35I spoke with you earlier.
38:36You took the payment for £10,000.
38:37He's going to pay the balance £9,044 and a few pens, I think.
38:41Yes.
38:42That's...
38:43Yes.
38:44That's...
38:45Okay.
38:46I'm going to pass you the gentleman.
38:47He's going to make another card payment for the rest of £9,000-something.
38:50Alright?
38:51Yeah.
38:52I'm going to pass it over to my colleague.
38:53Here you are.
38:54Yeah.
38:55Okay.
38:56Please take the details.
38:57Alright.
38:58The amount I'm going to process is £9,044 and 77 cents, yeah?
39:03Yes.
39:04Maybe it's not a big amount.
39:08Maybe it's a couple of thousand or a thousand pounds.
39:11The payment is successful.
39:12This has gone through.
39:13But when we go there, we go there on behalf of the claimant.
39:16We're going to send you a receipt on your phone number.
39:19Alright?
39:20Okay.
39:21Okay.
39:22I'm going to leave now.
39:23Bye-bye.
39:24When it comes to us in our job, we need to do what the court commands us to do.
39:27That's it.
39:28They're invested.
39:29For them, we are the last hope that they'll have to get their money back.
39:34You've got now about 15, 20 minutes.
39:49Otherwise, we're going to shut the shop down.
39:52David and Sherry are still trying to get their business debts settled.
39:56With the clock ticking for the company director to pay the bill.
40:01You are still the director, aren't you?
40:04Yes.
40:05Yeah.
40:06So you need to pay this.
40:08The director says that he's sold the business that owes the debt.
40:12But he's the only director on records for the company.
40:16We need to get it sorted.
40:18People say this all the time.
40:20They say, I'm not this, I'm not that.
40:22But at the end of the day, we're here with the high corporate.
40:25Yes.
40:26As the agents look at what stock in the shop they can seize to pay the debt.
40:30He apparently is a friend of the owner.
40:32That's what he's saying.
40:34A friend of the director comes into the store and says that he's been sent to find out what's going on.
40:40Yeah, look.
40:41Look, that claim number matches that claim number.
40:47It's dated a few weeks ago.
40:49And that's still coming in.
40:50That's been opening this address.
40:53The man says that the company director wants more time to deal with the problem.
41:00But as the debt has gone unpaid for months, Sherry wants a payment today.
41:04It's a serious situation.
41:06We're here with a writ from the high court.
41:09Oh, I understand.
41:10He keeps saying he's away and he's got no proof and everything.
41:13But the situation is, if it's not paid, we're going to take the stuff out of the shop.
41:19We're going to shut the shop down.
41:21The man calls the company director, who wants to speak to the agents again.
41:26I did make you aware of this.
41:28He had 25 minutes to pay.
41:29It's been well over that time.
41:31Wait a second.
41:32Okay, okay.
41:33Each stage of enforcement incurs additional fees, as set out by government.
41:38David and Sherry are at stage two, which has increased the amount of money now owed.
41:44If I pay 1,500, you can leave it.
41:48No.
41:49No.
41:50It's got to be 2,155 pounds.
41:52What is this?
41:53I can't...
41:54I say...
41:55Hey, you don't need to...
41:56Sir.
41:57You don't need to swear at me.
41:58Right.
41:59Why I say to you, look, we could take this further.
42:01We could take this further.
42:02We could shut your shot up.
42:04Which kind of the people you are.
42:06Why you don't understand?
42:07I say...
42:08I do understand.
42:09Look, sir.
42:10The company director has failed to respond to a county court judgment.
42:15And the claimant has been chasing the death for months.
42:19It's been over seven days since the notice of enforcement, which wasn't responded to.
42:25Forcing the agents into taking action today.
42:28Right.
42:29Let me explain.
42:30Do you want to pay 2,700 or do you want to pay 2,155?
42:35Of course.
42:36I want to pay 2,100.
42:39Right.
42:40I suggest you get this paid.
42:41If not, in the next 25 minutes we'll have to escalate it and looking to get locksmith and
42:46maybe shut the shop up.
42:47With the debt mounting for the business, it's decision time for the director.
42:52OK.
42:53Right.
42:54He's going to bring your cash and give it to you.
42:57All right then.
42:58Right.
42:59Realising that any further delay could increase the bill, he agrees to pay and asks his friend
43:04to go and collect the money.
43:06Oh, he's back again.
43:072,100.
43:08Exactly, yep.
43:09And 55.
43:10Is that all there, is it?
43:11Sherry.
43:12Do you want to count the number of the two loads?
43:13Yeah.
43:1420, 40, 60, 30.
43:15So you should have 1,000?
43:16Yeah.
43:17Yeah.
43:18Yeah, you've got 1,000 here.
43:19Yeah, give it that.
43:20Oh, you're giving it to me.
43:21Yeah.
43:22Yeah.
43:23Yeah.
43:24Yeah.
43:25Yeah.
43:26Yeah.
43:27Yeah.
43:28Yeah.
43:29Yeah.
43:30Yeah.
43:31Yeah.
43:32Yeah.
43:33Yeah.
43:34Yeah.
43:35Oh, you're giving it to me?
43:36Yeah, yeah.
43:37You're responsible, you see.
43:41Thank you very much.
43:44Very good result.
43:45Yeah, good result because the guy is just saying, oh, give me 24 hours.
43:50With our experience, we just could tell there was more to it than it had been right to trust
43:56our oil judgement on that.
43:57At the end of the day, we've got the money.
43:59Hopefully, the claimant will be happy about it.
44:01We're happy because we've done our job.
44:04We were fair, but we were very firm with them.
44:34We were very firm with them.
