00:04He's down in Collier County, arrested for DUI and possession of cocaine earlier this week.
00:12Marty Martinez, 48, was discovered by the Popo, sleeping behind the wheel of a pickup truck on the side of I-75.
00:22Not a good thing, because still, they'll stop and they'll see if you're okay.
00:27And if you're intoxicated, you're behind the wheel of your car, you're still in control of your vehicle.
00:32And I've had prosecutors say that if you're drunk and you're trying to sleep it off in your car, toss your keys.
00:41It's when you're able to operate the vehicle.
00:44So if you're drunk behind the wheel and your keys are accessible and you have access to operate the vehicle, that's sort of the legal trigger.
00:53But if you're in your car, passed out, like in a parking lot or on the side of the road, and your keys are not accessible, meaning you could not operate or move the car, that's a whole different legal situation.
01:05And I've heard that from numerous attorneys over the years.
01:07So the deputy said that he opened up the truck's driver's side door, woke this Martinez guy up, saw white powder all over his face, under his nose.

02:29The deputy used two handcuffs to detain Martinez for comfort reasons.

02:34Then, while Martinez was back in his patrol car, the deputy watched as he took multiple phone calls
02:40and then pulled two baggies of white powdery substances out of his pockets.
02:45As the deputy was completing the paperwork, Martinez shoved both bags up you know where.
02:54So the deputy witnessed the guy take bags of coke that he had, trying to hide the evidence.
03:01So the guy starts shoving the stuff up there.
