00:57:18Mr Baig, towards the end of his evidence, simply turned round and was outraged
00:57:24and said, do you seriously think that someone with my background
00:57:28and my responsibilities would, with the knowledge of something like this,
00:57:32would even allow it to happen, let alone be part of it?
00:57:35In my own community, on my own roads, where my own children would be travelling
00:57:40with my wife at that time.
00:57:46The question that is asked at court is, why did you no comment?
00:57:50From my perspective, when we did the police interview, I saw ambush after ambush.
00:57:55We safeguarded him.
00:57:58Mr Baig was really on the back foot because he's been asked to account for his movements and conduct
00:58:04many months ago, which he most likely cannot recall.
00:58:07There was this Hot Potato 818 phone that was used to contact all the key conspirators in the lead-up to the offence.
00:58:17So the jury then have to be 100% sure that Mr Baig is the one responsible for all those phone calls
00:58:24and being that key person involved in the conspiracy.
00:58:26Cell site evidence is one of those more difficult pieces of evidence to use in court.
00:58:33You could easily argue potentially, well, was that phone with somebody else parked outside the front of your house
00:58:39making that phone call. You lend that phone to another site and you didn't know what was going on with that phone.
00:58:45You know, just enough to start causing niggles of doubt.
00:58:50The reason why Mr Baig gave away the phone was because his brother-in-law asked him for it.
00:58:54Mr Baig did not know what the phone was going to be used for.
00:58:58His brother-in-law asked for the phone.
00:59:00The phone he wasn't using, he didn't think twice of it and just gave it to him.
00:59:05The police said that the second statement contradicted the first.
00:59:10The first statement said, I know nothing about that phone.
00:59:13The second statement was, oh yeah, that phone, I gave it to my brother-in-law.
00:59:17Let's face it, the number of times I have clients and I say to them, what is your number?
00:59:21Nobody knows their number. They have to go into their phones and find their own number.
00:59:26In his second statement, he actually made it very clear, now that I've seen the box, it's triggered my memory.
00:59:32So he's given an explanation.
00:59:43And there were a flurry of calls that were night before the shooting.
00:59:46And the police said, oh, there you go.
00:59:48This shows that what you're doing here is planning something because you keep calling each other regularly.
00:59:53However, there's actually an alternative and justifiable reason for the contact.
01:00:00They were discussing the purchase of protein shakes because Mr. Maroof owned a protein shop and Mr. Hussein wanted to buy protein.
01:00:11And because Mr. Baig was related to him, he was able to get a discounted price and make a profit.
01:00:15So it wasn't just a social arrangement, it was a commercial arrangement.
01:00:20And that's why there was such traffic between them for the purpose of that commercial transaction.
