00:00Republic Act 113 or Safe Spaces Act is also called Bawal Bastos Law.

00:13So what does this cover?

00:15All kinds of gender-based sexual harassment that happens in public spaces,

00:22in schools, work, or online.

00:25What is gender-based sexual harassment?

00:29This is the unwanted or non-consent of sexual acts and remarks

00:35or it can be obscene to us, to a person.

00:38This is known to be the motive of an accuser.

00:42So where is this place?

00:44This is the so-called public space according to RA 11313.

00:50So it can be in the streets and corners, buildings, restaurants and cafes, public parks,

00:57churches and schools, malls and markets, terminals, evacuation centers,

01:05government buildings and offices, public utility vehicles or POVs,

01:10including ride-hailing vehicles, resorts, public washrooms, and many more.

01:18And now, we want to know also, what kind of acts are prohibited under this law?

01:24There is catcalling.

01:28This includes misogynistic and sexist remarks,

01:32transphobic and homophobic remarks,

01:36unsolicited comments on the appearance of a person,

01:41repetition of giving personal information such as number and address,

01:47sexual comments and jokes,

01:50public masturbation or flashing or showing off,

01:55approaching, touching, and deliberately flirting with a person,

01:59and stalking.

02:02What kind of punishment can be given to the person who commits these acts?

02:07It depends on the type of sexual harassment and how often it happens.

02:14For example, the first offense is 12 hours of community service,

02:19gender sensitivity training, and a fine of Php 1,000.

02:24The second offense is 6-10 days in prison and a fine of Php 3,000.

02:31The third offense is 11-30 days in prison and a fine of Php 10,000.

02:40If the sexual harassment is demonstrated,

02:43the first offense is 12 hours of community service,

02:47gender sensitivity training, and a fine of Php 10,000.

02:51The second offense is 11-30 days in prison and a fine of Php 15,000.

02:59The third offense is 1 month and 1 day in prison and a fine of Php 20,000.

03:06What if the harassment is done through stalking, sexual advances, and touching?

03:14The first offense is 11-30 days in prison and a fine of Php 30,000.

03:19Gender sensitivity training is required under PNP and PCW.

03:25The second offense is 1 month and 1 day in prison and a fine of Php 50,000.

03:32The third offense is 4 months and 1 day in prison and a fine of Php 6,000.

03:38Imagine the amount of money a person can get for gender-based sexual harassment.

03:46That is why it is important for us to ensure that our partner is experiencing a safe space

03:54and that they are not being harassed.

03:55Or else, we might give them an uncomfortable situation.

03:59Or else, they might feel that they are being harassed.

04:04Let's all be careful.
