00:12that the government does not intend to pass this decision.

00:22It is the court's decision, it has to be implemented, the court has to do it.

00:38Look, the court does not have any soldiers, tanks, guns, right?
00:43The court's jurisdiction and, you can say, its obedience,
00:51has a direct relationship with principle.
00:55A society decides that we have to obey the decisions of our courts.
01:00We are a civilized society.
01:02We are not a group of wolves roaming in the jungle.
01:06So, this is what we call civilization.
01:09This is what we call a state.
01:11Even if it is not agreed upon that the court's decisions have to be obeyed,
01:15the Supreme Court's decisions have to be obeyed,
01:17then the state is overthrown.
01:19So, where we are standing at the moment,
01:21this is a very scary position.
01:23And the people of Pakistan, you and I have to make this decision.
01:27This is not a matter of politics.
01:29This is a matter of the survival of a state as a rule of law.
01:34Here, the law of the jungle, the law of violence,
01:37the law of fear and terror has to be followed,
01:40or some such law has to be followed,
01:42which comes before the courts after a discussion,
01:45after a deep consideration.
01:48Look, not every decision of the Supreme Court
01:51is agreed upon by all the people.
01:54This happens all over the world.
01:56People are divided in America.
01:58There, the elections of the president are fought on the basis of
02:01whether this decision is correct or that decision is correct.
02:04Because there, the president of the country
02:06decides the judges.
02:08And it is expected that the president will come and decide such judges
02:12who will give some specific types of decisions.
02:15So, there, this action is completely political.
02:19But what I mean to say is that there is a dispute in every country.
02:24But despite the disputes, the Supreme Court's decisions are accepted.
02:29If they are not accepted, then the state is destroyed.
02:32So, today we are standing there,
02:34that by accepting the Supreme Court's decision,
02:37the Minister of Justice of the country,
02:39the State Administration, the Election Commission are denying it.
02:43So, one aspect of it is what you said, Mr. Salman.
02:46But is there another aspect?
02:48For example, in this particular case,
02:50who is the most relevant authority?
02:52And whoever he is,
02:54can the court call him and tell him to apply?
02:57And even if he does not apply,
02:59can the court remove him from his post after the Supreme Court's decision?
03:03Yes, the court can do it.
03:05Everything can be done.
03:07And of course, the Election Commission
03:09has to choose the special seats.
03:11The decision has to be made in accordance with the law.
03:14But if the court calls him,
03:17and makes a decision,
03:19and condemns the court,
03:22will it be followed?
03:24Now, we are seeing such a situation,
03:26that only those decisions of the court will be accepted,
03:29which are the rulers of the time,
03:32and by rulers I mean those people,
03:34who have the power,
03:36the moral power,
03:38they have the power to lift people up,
03:41to beat them up.
03:43Their decision will be accepted by the Supreme Court.
03:47So, this is a very sad situation.
03:51And if I were to put it in your words,
03:54what will be the result of this terrible situation?
03:59Look, if you look at history,
04:02such incidents always weaken states.
04:07Whenever you do not listen to the voice of the people,
04:10whenever you try to dominate the courts,
04:14whenever you try to finish the biggest community in the country,
04:19whenever you try to remove the political leaders from the scene,
04:23the outcome is never good.
04:25We have suffered these scenes,
04:27in the case of East Pakistan.
04:29The Election Commission report is in front of us,
04:32but we learn nothing from it.
04:34Today, we are repeating all those mistakes.
04:36Those who are powerful,
04:38they think that they can suppress the voice of the people,
04:41scare them,
04:42intimidate them,
04:44but what will happen is that your state will become weak.
04:47You are giving this message to the whole world,
04:50that Pakistan is not a state based on a single law.
04:53It is a jungle law.
04:55So, why should anyone invest here?
04:57Why should factories be set up here?
04:59Why should people be given jobs here?
05:01So, you are shaking the whole country,
05:04its system,
05:06you are weakening it.
05:08Now, let's come to the logic they are giving as their own.
05:12What is the answer to this in your opinion,
05:14that the minister of law,
05:15who is giving a lot of logic,
05:16one of them is that,
05:17sir, a law has been made,
05:19that law is lawful,
05:20according to that law,
05:21I am speaking in the language of a common man,
05:23not in legal terms,
05:24and according to that law,
05:25one person cannot go from one party to another party,
05:28that is, the members of the Sunni Triad Council cannot go to the PTI now.
05:31So, okay,
05:32the court's decision stands with a different opinion,
05:35but in the country,
05:36this law is lawful,
05:37hence, it will not be able to act on this decision in this way.
05:41What will you say to this?
05:42The law is there,
05:43the parliament has made it.
05:44No, this is wrong.
05:45This is a completely wrong interpretation.
05:47The majority decision of the Supreme Court has proposed a law.
05:51The majority decision of the Supreme Court has said that,
05:53on 8th February,
05:55all the illegal actions of the Election Commission,
06:00despite all these,
06:02the members of the PTI have been elected,
06:05be it 80 or more,
06:08and they have to be given special sessions,
06:11according to Article 51 and Article 106 of the Constitution.
06:17Now, the Constitution is there,
06:19it is not possible that,
06:20after an election,
06:21you make a general legislation and end it.
06:25I would say,
06:26you cannot end the result of an election with a constitutional amendment.
06:29The election took place on 8th February.
06:31On 8th February,
06:32the Supreme Court decided that,
06:34the members who were elected,
06:36who were called free,
06:38the candidates,
06:39they were not really free,
06:41they were candidates of the PTI,
06:43and the elected members of the PTI were MLA and MTA.
06:46Now, no law can end this reality.
06:49This reality came into existence through the votes of the people of Pakistan.
06:53Despite all the corruption,
06:5580 seats came under the PTI.
06:58180 seats were supposed to come under the PTI.
07:00Despite all the corruption,
07:02the seats that came under the PTI,
07:04cannot be snatched from the PTI.
07:06And this is not a case where,
07:08someone left one party and joined another party.
07:13The Supreme Court has said that,
07:15all these people were in the PTI,
07:17they fought the election as candidates of the PTI,
07:21and they were elected as members of the PTI.
07:25There is no question in this,
07:27that someone left one party and joined another party.
07:29And this is a universal right.
