00:37Just two months after the following statement by former President Rodrigo Duterte and President Bongbong Marcos,
00:45Justice Secretary Boyeng Rimulya admitted that there are foreign entities in the country that are under the International Criminal Court, or ICC.
00:53He said to Reuters, an international news agency, that he knows this because of the human rights community that the ICC is in talks with.
01:02He also said that it is possible that they will talk with the ICC and there are people who are in the process of doing so.
01:09There are particular points where cooperation is possible, but it needs to be clarified that it is not yet in Italy.
01:18According to Rimulya, cooperation is possible in the International Tribunal under the law.
01:23When the palace was built, the opinion of the Philippines did not change,
01:28that the Rome Statute, or the treaty that is being formed in the ICC, was violated in 2018.
01:34The position is that we are no longer in the jurisdiction of the ICC.
01:38But that does not necessarily mean, because of what I just said,
01:41that does not necessarily mean that the order of the ICC enforced through the Interpol is to be ignored.
01:51Interpol makes the request to us for the arrest or delivery of the custody of a person subject to ICC jurisdiction.
02:00We will respond favorably or positively.
02:05Even though the ICC is not a part of the ICC, Interpol is still a member of the Philippines.
02:10We used to help them.
02:12It cannot be said that since the ICC requested you to come to us, we will not ignore you.
02:22If we are the ones who will request to Interpol, we will also not ignore you.
02:27Amidst the victims of the drug war that broke out in the ICC,
02:30the Rome Statute mandated the cooperation even though the Philippines withdrew.
02:37The writing of Article 127 of the Rome Statute, where we were previously signed,
02:42says that when you exit, it means that you forgot that you still have something to do.
02:50According to the former Chief Presidential Legal Counsel, Attorney Salvador Panelo,
02:55those who oppose the ICC should resign
02:58because President Marcos said that it cannot cooperate with the ICC in any way.
03:03However, the President also said last year that it is possible to cooperate with Interpol.
03:10As Secretary Remula explained before, we have obligations to Interpol.
03:17And we have to live up to those obligations.
03:21As of now, the ICC Prosecutor is still investigating the crimes against humanity committed by former President Duterte
03:29from November 1, 2011 until March 16, 2019,
03:33or one day before the Philippines effectively withdrew from the Rome Statute.
03:38This includes the drug war of Duterte in Davao when he was still the mayor of Davao.
