00:10In the middle of questioning Vice President Sara Duterte,
00:15in the evidence of the prosecution in the ICC against the former President Rodrigo Duterte,
00:21his lawyer gave the respect to the role of the victims in the process.
00:27He also believes that they will be given an interim release for the former President.

00:47that they will be given an international criminal court if they ask for an interim release for the former President.

00:58Lead Defense Counsel Nicholas Kaufman believes that the conditions of the former President Rodrigo Duterte's case
01:04for him to be given an interim release.
01:07He mentioned the usual reasons to refuse an accuser.
01:11The first of which is the risk of flight.
01:14The second of which is the risk of interference of witnesses with the evidence.
01:18And the third of which is the risk of continuing crimes.
01:21None of those factors exist in the present situation.
01:23According to their ruling in court,
01:25the international criminal court's jurisdiction cannot intervene in the case
01:29because the withdrawal of the Philippines from the ICC has already been effective
01:33before the investigation started.
01:35There is a compelling argument that the court cannot exercise its jurisdiction over the Philippine situation.
01:41And this is a live issue.
01:43It's an issue which has been through the Philippine courts.
01:45It's an issue that's been through the ICC as well.
01:47It is a compelling argument.
01:49We are trying to get permission for its immediate prosecution.
01:51But before, the ICC said
01:54that the crimes committed before the Philippines withdrew from the Rome Statute
01:57are still within their jurisdiction.
02:00So the court's jurisprudence has already indicated
02:05that the ICC retains jurisdiction even after the withdrawal of a state,
02:10but only for the crimes that allegedly were committed
02:13during the period when the state was a state party to the ICC Rome Statute.
02:18In addition to the international law expert and lawyer of the victims of the extrajudicial killings,
02:23Atty. Joel Butuyan,
02:25our Supreme Court also issued a decision
02:28that even though we are no longer members, we still have an obligation
02:32and the ICC still has jurisdiction for crimes committed
02:36while we were still a member of the ICC.
02:39The prosecution in the ICC pretrial chamber
02:42submitted 181 evidences as support
02:44for the alleged crimes against humanity or murder.
02:48This was questioned by Vice President Sara Duterte
02:51and I asked if the number is sufficient to say that there are crimes against humanity.
02:55For Kaufman,
02:57The victims have a role in the process.
02:59We have to respect that role
03:01and we hope that everyone will respect that role.
03:03Whether or not we agree with what the evidence coming out of the victims is,
03:07it's a totally different matter.
03:09But we will argue that in court, not here.
03:11Kaufman also reminded the former Vice President Duterte
03:14about the bill for the supporters.
03:16There should be no interference with the judicial process.
03:19The political politics is one issue.
03:22There should be full respect for all participants in that process,
03:26the prosecution, the defense, and the victims,
03:29counsel, who will make their submissions in due course.
03:31No one should interfere with that process.
03:34Let it run its course.
03:39Well, although in high spirits,
03:41Atty. Kaufman said that
03:43the former President Duterte is still having a hard time
03:46adjusting inside the ICC Detention Facility.
03:49He has been there for more than 80 years
03:51and he is still facing medical issues.
