00:00The former right-wing officer of Perbendaharaan
00:04urged the Malaysian people not to question
00:07Petronas' rights over oil and gas resources in Sarawak.
00:10In the middle of the report,
00:11the dispute between the national oil company
00:14and Sarawak Berhad Petroleum is still pending.
00:17Nik Azmi Nik Daud told FMT that
00:20Malaysia did not have control over its oil
00:23before the 1974 Petroleum Development Act was enforced
00:27because these rights were put in the hands of a foreign company
00:30for a period of time that was not established by the former colonial authorities.
00:34He also rejected the claim that
00:36Sarawak was not brought to discuss the PDA
00:39by saying that the law was rejected by Tengku Razali Hamzah
00:43with strong support from the Sarawak Prime Minister at the time,
00:46Abdul Rahman Yaakob.
00:48Nik Azmi said the two leaders played an important role
00:52in the development of Petronas and the nationalization of all oil resources
00:56as well as a petition for the transfer of rights
00:58has been signed by the Sarawak side
01:01by the State Council at the time, Bujangno.
01:04He also rejected the claim that
01:06the PDA was not passed by the Sarawak State Council
01:09by saying that it was passed by a two-thirds majority.
01:14Nik Azmi said there was no violation of the law
01:17for Petronas to be appointed as a gas aggregator
01:19because the Prime Minister was given power
01:21under Section 6 of the PDA to make the appointment.
01:25However, he said Petronas needed to manage all infrastructure independently
01:30and could not rely on Petronas for financial assistance.
01:33In addition, although the PDA gave Petronas control
01:36over all oil and gas mining activities,
01:39a country like Sarawak can be a partner
01:42through a joint development agreement.
01:45Meanwhile, a lawyer who has experience in oil and gas litigation
01:49rejected the claim that the PDA was not valid
01:52by saying that the court never decided it was invalid.
01:57He also rejected the claim that the PDA was an emergency law
02:01by explaining that the parliament was fully operational
02:04when the document was passed.
02:06The lawyer named Nggan also told the FMT
02:10that Sarawak does not have a right to oil and gas
02:13based on the federal institution.
02:16He said that the reception of oil royalties by Sarawak
02:18has always been contrary to the establishment of the country
02:21and that the 1958 Oil Royalty Ordinance violates the PDA.
