00:00President Bongbong Marcos and his cabinet members, including the Executive Secretary, secretaries of the Budget, Finance, Public Works, and National Economic Development Authority,
00:13the PAKSA, the so-called 2025 National Budget, were able to sign the budget on Friday.
00:19But Executive Secretary Lucas Bersamin said that it will not continue because it needs time for a thorough review.
00:27It is not yet clear when the budget will be signed, but Bersamin confirmed that there are parts that will be vetoed.

00:38Under Article 6, Section 27 of the 1987 Constitution, the President has the power to veto any law passed by the Congress.
00:47Under the Constitution, the President can veto particular items or just a part of the budget.
00:53As of now, the Bicameral Conference Committee passed a budget of almost Php 215 billion that was added to the budget of the DPWH
01:02compared to what was included in the National Expenditure Program or the proposed budget submitted by the Executive.
01:08More than Php 17 billion was added to the Camera and more than Php 1 billion was added to the Senate.
01:15The same goes for the Php 11 billion in the DepEd budget and the removal of the PhilHealth subsidy.
01:22The Php 26 billion budget was also added to the Ayuda para sa Kapos Angkita Program or ACAP
01:28that was removed from the Senate version but was returned to the Bicam.
01:31According to law expert Professor Dan Gatmaitan, the removal of a particular item is what the President can do.
01:38He cannot transfer it to another budget item that was removed from another program.
01:42For example, if the President vetoes the fund for ACAP, the fund that is included here cannot be spent even on other programs.
01:49The money will remain in the National Treasury.
01:52If the PhilHealth budget is vetoed, the subsidy will be zero, the original allocation of Php 74 billion will not be returned.
02:00Congress has to respond. I don't know. Next time or next year, they will be more careful or there will be special appropriations.
02:10Eventually, if it looks like money is really needed for certain things, there will be emergency mechanisms.
02:18Under the 1987 Constitution, the President's veto can still be overrided or the Congress' visa can be revoked.
02:25But this has not happened in history, according to Senate Minority Leader Coco Pimentel.
02:30Congress can insist that it still needs to be a law.
02:37It can insist by two-thirds vote of Congress per House voting separately to override the veto.
