A former cook escaped the hangman’s noose when the High Court in Johor Baru freed him of the murder of a 24-year-old man.

Calvin Phua Kim Hau walked out of the court a free man on Thursday (Dec 19) after the prosecution was found to have failed to establish a prima facie case against him.

00:22In his judgment, Justice Datuk Abu Bakar Katar said the prosecution failed to prove that
00:27the victim, John Liu Yuan's death, was caused by injuries inflicted by the accused.
00:33The court also ruled that two prosecution witness statements did not conclusively link
00:37Pua to the fatal stabbing.
00:39Judge Abu Bakar said the accused's mere presence at the scene, without other actions, was not
00:44enough to link him to the murder.
00:47The prosecution was represented by Deputy Public Prosecutor Mohamed Shafiq Mohamed Ghazali,
00:53while Pua was represented by lawyer Mohamed Daud Ismail.
00:57Pua was accused of murdering the victim at the guardhouse of an apartment unit in Jalan
01:02Masai, Jaya, at around 2.30 am on June 3, 2018.
01:08The offence was framed under Section 302 of the Penal Code for Murder, which carries a
01:14death sentence upon conviction.
01:17Thirteen prosecution witnesses testified in the trial, which began in 2022.
