00:25Sir, what is the objective of the Directive of President Ferdinand R. Marcos Jr. in the Bureau of Customs and Department of Agriculture
00:33Code 9 of Republic Act No. 12022 or the Anti-Agricultural Economic Sabotage Act?
00:42The President wants this to be implemented properly because we still know why this was repealed.
00:50This is a revised version of the Anti-Agricultural Economic Sabotage Act.
00:55We are emphasizing the crimes that can be used to manipulate prices and to take advantage of the situation
01:08to increase the prices of the primary goods, to abolish what is happening in the markets, and to do these things to the detriment of our public.
01:23Sir, how will the BOC and the DA implement the Anti-Agricultural Economic Sabotage Act in the country?
01:35Aside from our closer coordination in monitoring our ports, the DA and the Bureau of Customs will also have other activities
01:48such as inspecting using the letter of visitorial powers of the Bureau of Customs in other warehouses and other places
01:58to ensure that the products of agriculture that were impacted there paid the right price,
02:07have the appropriate permit from the Department of Agriculture, and have been properly processed.
02:11Through that, the Department of Agriculture will also see if there are other violations that are being done
02:18such as hoarding and other activities that can manipulate prices.
02:26Sir, what is the difference or the primary change of the Republic Act 12022
02:33compared to the previous law, the Anti-Agricultural Smuggling Act of 2016 or RA-10845?
02:42First of all, more agencies of the government can implement this.
02:46The coordination of the various enforcement agencies of our government has been strengthened in order to implement this properly.
02:54Second, there are more specific crimes that are defined here that are really affecting the study and investigation of our judges and our government.
03:07These crimes need to be defined so that they will not be used and abused.
03:14These are the primary crimes that are used to manipulate the prices of our basic commodities
03:20including hoarding, profiteering, and other practices that are used and abused to manipulate the prices
03:30and to create false situations in the market to increase the prices, again, to the detriment of our public good.
03:42Attorney, according to your data, how significant is the importance of smuggled agricultural products
03:49that were smuggled by the DOC this year, and how big is the loss to the government if it is not stopped?
03:57It is big in our data. In fact, the disaggregated amount of agricultural products that we caught for this year
04:13has reached more than Php 1 billion. But for all smuggled products, our intelligence group caught more than Php 80 billion.
04:26But if we are talking about agricultural products, the price of the Bureau of Customs caught this year,
04:38if this year we were able to catch more than Php 1 billion of agricultural products, we would have been able to catch more.
04:52So here in Nasamsama, known as Smuggled Mackerel, what agency was used by the DOC to smuggle these products?
05:03One of the important agencies that provided us with the relevant information here is our Department of Agriculture.
05:12Sir, for now, what steps are you taking with the DOC so that the cases of smuggling of agri-products by the country will not happen again?
05:23We are tightening our surveillance on our ports. We are using a risk-based system together with the Department of Agriculture
05:32so that the smuggled products will not be disturbed.
05:38Our next inspection will be done on the warehouses where the smuggled agricultural products are hidden.
05:50So that we can check if this went through the process, if there is a valid permit from the Department of Agriculture, and if the right fees were paid.
05:58Through that, we can make sure that the supply is sufficient and that the supply is not being intercepted.
06:06Okay. In other talks, we asked for an update on the abandoned Balikbayan boxes. How many are unclaimed as of now?
06:20There are still many. In fact, we are processing about 15 Balikbayan boxes for us to donate to the Department of Migrant Workers so that they can distribute.
06:37The first batch of these, the need of donation, was studied by our DMW. We hope that they will be able to distribute this this week.
06:48And before Christmas, hopefully we can start distributing this first batch of donated Balikbayan boxes to their recipients.
06:58These Balikbayan boxes became victims of unscrupulous deconsolidators and consolidators.
07:06In other words, the UFWs in our country took the money, but it was not processed when it arrived here in our country.
07:13So the Bureau of Customs and the Department of Migrant Workers made a way for this to be processed after they were abandoned.
07:21The DDCAP or Deconsolidators Association of the Philippines and the DMW helped. We can distribute this in the coming days.
07:32So will these Balikbayan boxes be sent to the intended recipient or will you give this to other people?
07:44No. We will give this to the intended recipient. Because we know how the UFWs took advantage of this to send this to their families.
07:55And it's not their fault that someone deceived them, that they have a bad heart, that they will help them in their business and in the delivery of the Balikbayan boxes.
08:09But they took advantage of our UFWs. So because of that, it's the duty of the government to protect and organize such a system.
08:20At the same time, to make a way for the Balikbayan boxes to be sent to the families of our UFWs.
08:28And that's what the Bureau of Customs and the Department of Migrant Workers are doing right now.
08:33Okay. That's good news that it will be given to the intended recipients.
08:39And hopefully, before Christmas, because it's almost next week, when will this be given to them?
08:47Ma'am we are targeting to start donating them for distribution to DMW. If DMW can agree on the details of the donation, hopefully by late this week to early next week.
