Gwyneth Paltrow says she felt like she was being shaken down during her infamous ski crash trial ... adding the very concept of getting sued by someone who was totally at fault stands out as everything wrong with the American legal system.

01:01Well, the best part of it really was just how the internal eye roll the whole time at the fact that you were there at all.
01:08The whole thing felt so honestly funny because it was so ridiculous.
01:12You know, it was ridiculous.
01:16And I have to say, like, the idea that somebody could ski into your back and knock you down and then sue you, I was like, this is everything that's wrong with our legal system.

01:29And that's why I felt like I had to fight it.

02:10So we, in our system, we allow everybody to sue and then it comes out as it was.
02:13But Gwyneth Paltrow can withstand the financial burden, but a lot of people can't.
02:17I think there's a point here that this kind of, like, frivolous lawsuits are really bringing down our system.
02:21We say this all the time, that people...
02:23You can sue for anything.

02:25And yeah, that means someone's going to have to go through the process.
02:29But the alternative, how do you fix that, Jason?
02:36Well, in Europe, for example, the losing party typically has to pay the prevailing party's attorney's fees.
02:43But not in a personal injury case in the United States, and that's the problem.
02:48Not in the United States.
02:48So that's something you could change.
02:49But then you would say, on the other side, the way Europe does it, it prevents sort of people who can't afford lawyers in the first place from being able to bring their claims.
02:56Because the fear of loss is too great or bankrupt them.

02:59And they may have a good claim, but that doesn't mean they're going to win.
03:02You never know if you're going to win.
03:03And if you're not sure and you end up having to pay attorney's fees, you just don't sue.
03:07And you don't vet your legal rights.
03:09So therein lies the issue.
