00:10Former President Rodrigo Duterte formally signed the conforme
00:14to be his lawyer in the International Criminal Court,
00:17the British-Israeli lawyer Nicholas Kaufman.
00:20Vice President Sara Duterte is no longer part of the defense team.
00:24That is the latest in the Netherlands in the report of Marie Zumali.
00:31We visited the former Executive Secretary Salvador Medialdea,
00:35the former President Rodrigo Duterte,
00:37in the Scheveningen Prison in The Hague, the Netherlands.
00:40According to Medialdea, the former President's condition is fine
00:43and he has also recovered from his sleep.
00:45Duterte's camp helped to form a panel in the defense team.
00:50Medialdea said that the British-Israeli lawyer Nicholas Kaufman
00:54formally signed the conforme to be his lawyer in the International Criminal Court, or ICC.

01:04While Vice President Sara Duterte is no longer part of the defense team
01:08and is now a member of the Next of Kin, or Immediate Family.
01:12VP Sara will not be the President's lawyer
01:15because under our law, there is a prohibition on the practice of profession.
01:20Duterte's legal team has more than six months to prepare their defense
01:24for the confirmation hearing on September 23.
01:27They also plan to trash the complaint of Crimes Against Humanity against Duterte.
01:31Who will pay Duterte's legal fees?
01:34Of course, the defendant will pay first.
01:38If he has no resources to commensurate with the attorney's fees,
01:45the ICC will provide that.
01:48The government will not pay because these proceedings are outside of the Philippine territory.
01:55While the former President is under house arrest,
01:57he can contact Duterte and his defense team online.

02:02the detainee's cell phone has its own computer linked to the ICC's computer.
02:07Only the detainee and his defense team have access to the computer.
02:11Detention center staff will not monitor this as a violation of the right to privacy

02:17According to the application for the warrant of arrest of the former President Duterte in the ICC,
02:22as part of the evidence used,
02:24Duterte's witness statements, testimonies and public statements,
02:28his orders and memoranda,
02:30documents from the PNP and other government agencies,
02:34as well as the drug watch lists issued by the authorities.
02:38Duterte's confessions that he was the Davao City Mayor,
02:42he killed 1,700 people,
02:45he was a member of the Davao Death Squad,
02:47and he was charged with extrajudicial killings,
02:49as well as the statement that his only crime was EJK.
02:53My only crime was the extrajudicial killings.
02:57He also alleged that he was involved in illegal drugs
03:02during his inauguration as President.
03:04More than 6,000 victims were charged by the lawyers of the victims of extrajudicial killings under Duterte.
03:11But only 43 victims of the Davao Death Squad and Duterte Drug War were presented to the ICC.
03:17The prosecutor, based on his prosecutorial discretion,
03:21chose these emblematic events or murders.
03:25If Duterte is proven guilty,
03:27he may receive reparation or damage to the victims or their relatives.
03:32This should be paid by the defendant.
03:34So while he was being interrogated,
03:36he was asked where the assets of the victims were and he was asked to freeze it.
03:40But because the Philippines violated the Rome Statute established by the ICC,
03:44It will be up to the President in the sense that the President will direct the necessary agency
03:51to do the necessary legal remedy.
