00:00The arrest of former President Rodrigo Duterte by Interpol is still pending.
00:05We will talk to former Senator Antonio Trellanes IV.
00:08Good morning and welcome to Balitang Hali, sir. This is Connie Sison.
00:12Good afternoon to you, Ms. Connie and to Rafi.
00:17What can you say about the former President Duterte's request for a writ of habeas corpus?
00:25This is expected that they will do it because that is the playbook of the former leaders of our country
00:35who are facing various things, they are the ones who are suffering and they will use all the legal technicalities
00:48so that they can avoid what they are facing.
00:52Do you think that there is a chance that the former President Duterte can return here in the Philippines?
01:00Now that he is being taken care of, they are saying that he will go to The Hague, the Netherlands, the former President Duterte.
01:10Physically, it is impossible for that to happen because if the plane lands in the Netherlands,
01:18immediately, Duterte will be turned over to the ICC.
01:24The ICC will turn him over to the Netherlands authorities to detain him in their facilities while pending trial.
01:38But aside from that, we have seen that the police and the Marcos administration in general became transparent
01:50regarding the arrest of Duterte.
01:53They all have body cams, they have video recordings that respect his rights.
02:01All the due process is observed precisely so that they can see the difference that the arrest of Duterte is right.
02:14They used a lot of legal basis for that.
02:19Aside from the Interpol, the Supreme Court has a ruling that the ICC is under restrictions at the time when we were still members.
02:34That is the basis of these cases.
02:37Then there is the Republic Act 9851 where the government can surrender an accused, like Duterte,
02:50if he is facing an investigation by an international tribunal.
02:58So very, very specific.
03:00All have a legal basis as to why this happened yesterday.
03:05Okay. With regards to the TRO in the Supreme Court, will there be a basis for this case?
03:16Some international law experts are saying that the international courts will be lower than ours.
03:25What is that?
03:26The TRO's actions in the Supreme Court are already moot and academic because it cannot be undone.
03:36If it is already happening, how can you prevent the arrest?
03:41He was already arrested and turned over.
03:43So what is that?
03:45Exercise in futility.
03:46They are just trying to erase this issue.
03:49Because they want to project to the people that Duterte is an innocent person who is pitiful,
03:57who is being persecuted politically by the Marcos administration.
04:04That is what they want to project.
04:06But what you see, that is why I want to remind our fellow countrymen,
04:12that what you see in Duterte's image, that he is pitiful,
04:17let us not get involved in that because I will bring you to the time when he was the president of our country,
04:27when he was in power in 2016 to 2022.
04:30He put aside our laws and he ordered thousands of Filipinos to be killed at that time.
04:40We know that. We witnessed that.
04:42The poor people, the people who live in squatters areas,
04:46their houses were let in to kill them.
04:49That is the image we should remember.
04:52Thank you very much for your time here in Balitang Hali Center.
04:58That was former Senator Antonio Trillanes IV.
