00:00Because of the violation of the Rome Statute of the Philippines in 2019, Interpol passed a process for an arrest warrant against former President Rodrigo Duterte.
00:10Now, they are going to the Supreme Court to stop the arrest.
00:16Salima Refran is on the case.
00:22On March 7, the International Criminal Court pre-trial chamber issued a warrant of arrest for former President Rodrigo Duterte.
00:29The pre-trial chamber accepted the need to arrest Duterte because the ICC prosecutor believes that there is no reasonable expectation that Duterte will help when the summons came out from the court.
00:41But because of the violation of the Rome Statute of the Philippines in 2019, and the ICC did not have a state party, the Interpol or International Criminal Police Organization passed a warrant.
00:52The government said that they will follow the warrant.
00:58From Interpol Manila, the warrant was passed to PCTC or Philippine Center for Transnational Crime, which processed the arrest of Duterte through the Law Enforcement Agency, PNP,
01:10which was implemented by CIDG.
01:12In the Malacanang statement, Prosecutor General Richard Fadulyo read the ICC notification.
01:18The judge assured that the warrant is in accordance with the law on the process of arresting the former President.
01:24If there are questions about the validity of the warrant, it should be questioned in the court that issued it.
01:30Meanwhile, former President Duterte and Senator Ronald de la Rosa filed a lawsuit in the Supreme Court through their lawyers to stop the Philippines from following the ICC and to implement the warrant against Duterte.
01:44In the 74th page of the Petition for Certiorari and Prohibition, the Philippines violated the law on the warrant of the ICC and questioned the constitutionality of the arrest of Duterte.
01:55The petitioner also requested a Temporary Restraining Order, Preliminary Prohibitory and Mandatory Injunction, and Permanent Injunction and Prohibition that prohibits the following,
02:05to assist and assist the ICC and to assist Interpol in the implementation of any legal action from the ICC.
02:14The petitioner also requested the release of the petitioner, Sen. Duterte and de la Rosa, and other connected to the ICC investigation.
02:23On the ground, based itself on the Rome Statute, Article 127, Paragraph 2, which states that after we have withdrawn from the Rome Statute,
02:34Philippines is no longer under the jurisdiction of the ICC.
02:38Since the Philippines is no longer a party to the International Criminal Court, then it has no business anymore cooperating with such body including the International Police, Interpol.
02:52We are earnestly praying to release outright from custody our beloved former President Rodrigo Duterte on the ground that his detention now is illegal, unconstitutional and has no basis under the law.
03:10Respondents to the petition, Sen. Executive Secretary Lucas Bersamid, DOJ Secretary Boyeng Rimulya, DILG Secretary John Vic Rimulya, PNP Chief General Romel Marbil, CIDG Director General Nicolas Torre III,
03:23Solicitor General Menardo Guevara, DFA Secretary Enrique Manalo, AFP Chief General Romeo Browner, and Bureau of Immigration Commissioner.
03:32We are still trying to get the attention of the respondents.
03:35Meanwhile, Chief Presidential Legal Counsel Juan Ponce Enrile said that the law in the Philippines is not the result of Duterte's actions, but of the ICC.
03:44That is why it is not right for him to blame the government.
03:47The lawyers of the former President should be able to get a copy of the cases against him to find out why he was arrested.
03:55The Philippine Domestic Law has nothing to do with his legal problem.
