00:00After the arrest of former President Rodrigo Duterte,
00:04what is the next process that he will face in the International Criminal Court?
00:08Details in the national news of Harley Valbuena of PTV Manila.
00:158 years after the International Criminal Court filed a case of Crimes Against Humanity
00:20because of the bloody war on drugs,
00:22today, the former President Rodrigo Duterte has already been arrested.
00:27But the question of many is, what will happen to the former President?
00:33According to the ICC website,
00:35there are 6 processes that will be carried out in a criminal case.
00:38First, the preliminary examinations will be completed
00:42where the prosecution will determine if the evidence is strong enough
00:46and if it is in their jurisdiction.
00:49After the evidence is gathered,
00:52the ICC judge may request the issuance of an arrest warrant or summons to appear.
00:58The ICC may request the assistance of a country in arresting
01:02and transferring their custody to The Hague, Netherlands in a court of law.
01:08Once the accused is held by the ICC,
01:10a pre-trial will be conducted
01:12to listen to the prosecution, defense, and legal representatives of the victims
01:19and the ICC judge will decide if he will appear in a proper trial or not.
01:25In the trial stage, the prosecution will give a chance
01:29to prove that the accused is guilty beyond reasonable doubt.
01:33Three trial judges will hold him,
01:36and if he is found guilty,
01:38he may be sentenced to up to 30 years in prison or life sentence.
01:45There is also a chance for the accused to appeal
01:49to the five judges of the ICC Appeals Chamber.
01:53If he does not appeal,
01:55the sentence will be carried out
01:57and a convicted will fill it
02:00in a country that has an agreement with the ICC
02:03for the enforcement of ICC sentences.
02:06Among the well-known people involved in the litigation of the International Court
02:11is the former Serbian President Slobodan Milosevic,
02:15who was convicted of crimes against humanity, genocide,
02:18and war crimes in 1999 due to the Yugoslav wars.
02:23However, the litigation did not end
02:26until he was released in 2006.
02:30From PTV, Howard Valbuena for Balitang Pambansa.
