00:00The only reason or motivation, actually, is racism that I can see, and if we give the power to Congress to determine who are and who are not U.S. citizenship, it will be subject to abuse and chaos here in America.
00:23You used to be a matic American citizen when you were born in America, but it looks like it's going to change in the coming months. This is because of the policy of the current President of America, Donald Trump.
00:37What is birthright citizenship, and why does Trump want to stop it?
00:43I'm Humor Yanga, and here's what you need to know.
00:48In his inauguration and first day as President of America, Donald Trump passed 26 executive orders, including his policy to stop birthright citizenship, or becoming a U.S. citizen, of any parent's nationality.
01:06In the whole world, 33 countries give birthright citizenship as America. According to the 14th Amendment of the U.S. Constitution, more than a century of the United States is recognized as a U.S. citizen.
01:23Birthright citizenship was passed in the 14th Amendment of the U.S. Constitution. It was passed after the Civil War. The Supreme Court had ruled already that anyone, even if of a different race, as long as they are born here, are considered a U.S. citizen.
01:45Trump did not agree with this, so he wanted to change the definition of birthright citizenship.
01:50This was followed by his declaration of illegal immigration as a national emergency. He also wanted to stop what is called birth tourism, where mothers and their children cross the U.S. border to become U.S. citizens.
02:07So they're not just amending a law, they're actually amending a constitutional provision which has been there for the longest time.
02:16What Trump wants to change now is that not everyone who was born in the U.S. will become a U.S. citizen.
02:25Because in the Citizenship Clause, whoever was born is a U.S. citizen.
02:30Now, he said that if the parent is not a U.S. citizen or green card holder, the child born in the U.S. is not a U.S. citizen.
02:41It's not just that. It's not just that the illegal immigrants are not targeted. Even the temporary visa holders, if you were born here on a visitor's visa or a working visa, you're studying, you were born here in America,
02:58your child will no longer be a U.S. citizen under the executive order issued and signed by President Trump last week.
03:08According to studies, millions of undocumented immigrants live in the U.S. now.
03:13That's why this policy has a huge effect on many families, including the Filipinos there.
03:19Assuming that this birthright citizenship is repealed, assuming that we're talking about it,
03:27the immediate effect of that will create another level of population that is not a citizen.
03:36For example, if the parent has an unlawful status, there will be another level of unlawful presence.
03:43Then, of course, the child's allegiance to where he was born.
03:47If you raise a child here in America, of course, he will be confused. Instead, he will have the motivation to really become a good and productive citizen.
03:59What will happen to him? He will be prejudiced, he will become a victim of exploitation, and he will not be alone.
04:09What will happen to our immigrant community in America?
04:16So that effect, for me, is very chaotic. Not only that, what about the implementation?
04:22If this is repealed, for example, are you a citizen or not?
04:26Everybody now has to prove who was born here.
04:29They will ask again, are you a parent or a citizen?
04:32It's just that too many bureaucracies will happen if this is going to be implemented.
04:38Now, some Filipinos in America are worried about their situation.
04:44Many are asking because what they understand about birthright citizenship could be like,
04:51will it affect me because I was born here? Will Trump take my citizenship?
04:58Well, I tell them, oh, this is going to be prospective.
05:02This effect is not retroactive.
05:05If this is going to pass, if your citizenship is already with you before it was enacted into law, it will not be removed.
05:15Except, again, we don't know, the Congress will be fluid.
05:20There's such a thing as denaturalization.
05:23Denaturalization is what the United States calls the recovery of citizenship from an immigrant
05:29who was naturalized or obtained citizenship in the legal process.
05:33But that will entail a court hearing.
05:37It's not like right away, hey, your parents were not born here.
05:42We're getting your citizenship.
05:44There has to be like a reason, legal basis to do that.
05:49So it's not easy.
05:50But I do not blame them.
05:52They are afraid because they were born here.
05:56Because of all this hype of racism right now here in America.
06:02Anti-immigrants are very strong right now.
06:06Those who are affected are not only the illegals, but also those who are, you know, all immigrants are affected.
06:15Since I've actually witnessed legislation that have been introduced and have failed in Congress,
06:22I think there is a bigger likelihood that it's not going to pass.
06:27But in the worst case scenario that it's going to be passed,
06:31I would suggest they consult with their attorneys before taking any action.
06:37Not for anything else.
06:39But, you know, there's a tendency to make a major decision on their lives based sometimes on misinformation.
