00:00We are all in the same boat, and yet we are all different.
00:03If we look at all three of us in the same boat, then justice cannot be achieved.
00:08The job of investigation is to gather information,
00:12the job of prosecution is to present it,
00:15and the job of justice is to gather the information and present it,
00:21and to provide justice in the best possible way.
00:25And this subtle difference should always be kept in mind,
00:29because the day this difference is eliminated,
00:32then the last person in the society will have to face justice.
00:37And this difference can be seen somewhere,
00:41it is being mixed up,
00:43where investigation and prosecution feel very excited,
00:48and where they try to get excited,
00:51they should be separate, they should act independently.
00:55When you receive a charge sheet,
00:58then you should analyze it in a subtle way,
01:01you should vet it,
01:03and you should see if there are any mistakes in the investigation.
01:07There is no fraud against an innocent person.
01:16Is the information given about the right person or the right crime,
01:23that is being investigated for many other reasons,
01:28we know that on the administration of the society,
01:31on other parts of the society,
01:33and on the judiciary as well,
01:35there is an effort to bring pressure.
01:39But this is the discretion of the officer,
01:42how he deals with that pressure.
01:46But there is a society, there are inconsistencies in the society,
01:49there are good things as well,
01:51how do we filter those inconsistencies,
01:54and remove them,
01:56I think this is a very important task of prosecution.
02:00Look, wherever the rights have been given,
02:05there are duties along with the rights,
02:09and our role becomes even more important.
02:12I was just looking at the statistics,
02:14which is running on your screen,
02:16that there is an increase of 47% in the number of cases of rape against women.
02:21In Madhya Pradesh, we can take credit for one thing,
02:25and the main credit will go to the police authorities and the district administration,
02:31that reporting is still easy here.
02:35And because reporting is easy,
02:37the report in our National Crime Bureau,
02:40it seems that the number of crimes here is very high.
02:44But I am not concerned with the statistics,
02:48but I give credit to both these wings,
02:51that comparatively, reporting of crime is easier here,
02:56and therefore a common man is able to report the crime,
03:00be it against, under the SCST Act or under any Act,
03:03which gives a higher figure.
03:05In some other states, this reporting is not so easy.
03:09But after saying this,
03:12I would like to say one more thing,
03:14that we have such cases,
03:16where this Act is misused,
03:19only to get compensation,
03:21or to harass the person in front of you,
03:24small cases are filed,
03:26in which the police's involvement,
03:28requires the guidance and investigation of some officials like you.
03:36Either investigate mechanically,
03:39or file a report,
03:41and we go into the depth of the matter,
03:44and investigate whether the matter is true or false.
03:49Yesterday, in an appeal,
03:51two boys were released after 6-7 years,
03:54and it was found that the entire case was false.
03:56The person who went to jail for 6-7 years,
03:59he became a stigma in the society,
04:01he became isolated from the society,
04:03and when he comes back from jail today,
04:06what kind of employment will he get,
04:08what kind of life will he lead,
04:10and what will be his future?
04:12We need to think about this too.
