00:00In a particular way, and assuming the role that I have as a congressman,
00:08whose competence has to be not only to propose legislative initiatives,
00:17but also to observe the establishment of powers.
00:22In the end, we, in one way or another, take the most appropriate decisions,
00:28much more so when we ourselves are elected through the Congress.
00:33Regardless of the fact that the Constitutional Court of Appeals is an elected body by the Council of the Magistrate,
00:42it is not true that the Council of the Magistrate is composed, among other things, by legislators,
00:48both from the Senate and from us.
00:51So, on that basis, it has not caught our attention.
00:58The fact is that, sadly, the decision of the TC, in the last sentence,
01:05was to give space for independent changes to be promoted,
01:14without knowing exactly the powers that the Congress has to make the proposals of the party law,
01:26the electoral regime law.
01:28This sentence draws the attention of the Congress,
01:32that it is not ordering to write the law as it should, and that is not its competence.
01:38So, I feel that the TC has invaded decisions that are proper to the Congress,
01:47and they are basically to review the constitutionality of the laws that are voted,
01:54not even those that are proposed.
01:56They have no instance, none, not even to be proposed by law.
02:03The judicial power and the electoral court have them,
02:08in each of their competencies.
02:11So, the fact that they have not ordered to correct how the laws should be written has caught our attention.
02:21And not only with this, that this sentence invites anyone to,
02:26first of all, to disclose the party law.
02:29Second, to give the essence to any individual,
02:35depending on his commitment to society,
02:40to be able to write a candidacy without meeting the minimum participation rules,
02:48and on that part, to not know, and to create difficulties for the electoral regime.
02:56If you add all this, you see no reason for a person not to be able to place himself
03:04within the 36 options of the political party.
03:07There are 36 parties, 34, 36, and I feel that there is a menu for each one,
03:14that there is an option for all, for the ultra-conservatives and for the ultra-progressives.
03:24So, if there is such a wide menu, you don't have 36,
03:28that you can't meet exactly all of that,
03:31that you have to give space for Juan de los Palos to be able to write a candidacy,
03:36to not meet a series of requirements, for example,
03:40of voters or Dominicans who value, validate, the participation of a party.
03:46So, in that direction, the product of that invasion of land by the Constitutional Court
03:53and not only this, but that the Constitutional Court, in a cheerful way,
04:00made a decision that has to do with questioning the constitutionality of the law,
04:10of the DNI, of Law 124, about the form, because the Supreme Court did not say
04:18before voting that the law was going to be organic,
04:21however, it does not go to the bottom, which is what worries the citizens,
04:26basically, about the ignorance of fundamental rights that are in Law 124,
04:35which was basically the object of questioning, not how it was presented.
04:40So, in that aspect, I draw attention to the fact that
04:49how much is missing Milton Rey Guevara, who was president of the Constitutional Court
04:55and never, absolutely never, there was questioning of his decisions,
05:02regardless of the fact that Milton Rey Guevara was a senator and a member of a party.
05:06Nobody questioned Milton, the fact that at a certain moment he had political militancy.
