Former presidential spokesperson Harry L. Roque did not appear on Tuesday, Dec. 3, during the preliminary investigation of the qualified trafficking in persons charges filed against him at the Department of Justice (DOJ).

However, Roque -- through his lawyers -- submitted his counter-affidavit that appeared to have been notarized in Abu Dhabi, the United Arab Emirates.

00:00According to the panel, a counter affidavit was submitted by the lawyers of Harry Bote.
00:05It would appear that he had a document which was notarized, but he was in Abu Dhabi.
00:12So the panel opted to give the respondent a chance to call for a clarificatory hearing
00:19which would be scheduled anytime between now and the 16th of December.
00:26The purpose is to clarify certain issues and to find out really where Mr. Harry Roque is at this point in time.
00:34Under our rules, the prosecutor should be given the opportunity to examine whoever it is who submits counter affidavits.
00:42And in this particular case, the whereabouts of Tiny Harry Roque is unknown to us.
00:48There is a document that comes out that he is outside of the country.
00:52Now, even if he submits a counter affidavit through his lawyers,
00:55it does not mean that the panel will immediately accept it
00:58because number one, it is not in the jurisdiction of our panel here in the Philippines.
01:03The only way that we can consider that is if he executes the affidavit
01:07and has it notarized or up to still before the embassy of the country where he is at that particular time.
