Deputy Minister in the Prime Minister’s Department (Law and Institutional Reform) M. Kulasegaran told the Dewan Rakyat on Nov 18 that the police can now block or seize transactions involving funds suspected of being linked to financial crimes, including mule accounts.

00:02Ladies and gentlemen,
00:03in the second and third sessions of the 15th Parliament,
00:08the Government has passed the RUU Law on Torture and Transportation 2024
00:18and the RUU Law on Criminal Procedures 2024
00:24and the RUU Law on Criminal Procedures 594 respectively.
00:37Both of these Laws have been passed by the People's Court on 10 and 11 July 2024
00:45and by the State Court on 22 July 2024.
00:49Subsequently, both of these Laws have been approved by His Excellency Sri Paduka Baginda
00:59on 11 September 2024
01:02and have been published in the newspaper on 25 September 2024
01:07and have begun to be approved on 30 October 2024.
01:12These amendments, which have been made in Article 574 and Article 593,
01:19in accordance with both of these Laws,
01:22have been passed to create criminal charges in the law
01:29related to the Keldai account,
01:32this is with the permission of the Mule account,
01:34and new provisions that give power to police officers
01:39who embezzled money that was estimated to be involved in criminal activities
01:44that were kept in any financial institution.
01:47In this regard, the amendment of Article 953,
01:51among others, has included the introduction of a new section 116D
01:57to give police officers who are not less than a sergeant
02:01the power to embezzle and prohibit transactions in any money held
02:08to be held in any payment instrument
02:14and or any account in financial institutions
02:20and make provisions for related matters.
02:24This amendment allows the police to not only embezzle
02:31but also to prevent the asset from being made into another business
02:37with the aim of preventing online scam victims
02:41from being removed from the Mule account
02:44and will then complete the existing provisions,
02:49namely Section 435 of Article 593
02:53on the power of the police to embezzle stolen assets,
02:58including physical assets.
03:03In this case, the police can prevent
03:071. have a reason to suspect that an error has been made
03:142. have a reason to suspect that the asset has been used
03:21or intended to be used to commit an error
03:26or 3. have a reason to believe that the asset is evidence of an error.
03:35In addition, based on statistics recorded by the National Scam Response Centre NSRC
03:44from October 2022 to September 2024,
03:51the number of calls received from the public was 131,036
03:59and from that number, a total of 52,836 people were found
04:05to be scam victims
04:08with a reported loss of Rp 302.1 million.
