00:00The government is obliged to pay RM9.45 million in damages and costs to a boy who suffered
00:07brain damage at birth.
00:09This comes after the government failed to challenge the Court of Appeal ruling when
00:13the 30-day deadline expired on October 25th.
00:17The sum awarded is believed to be the highest handed down by a Malaysian court in a medical
00:22negligence suit filed involving a government hospital.
00:26On September 25th, the Court of Appeal dismissed the government's appeal to reduce the RM7.6
00:32million award by the Penang High Court and instead increased the sum to RM9.45 million.
00:39In 2014, the boy's mother was admitted to the Penang General Hospital for irregular
00:43uterine contractions while being 37 weeks pregnant.
00:47Three days later, the baby in utero suffered fetal distress but the doctors delayed in
00:52delivering the baby.
00:54The plaintiff contended that the excessive delay caused the child, now 10 years old,
00:58to suffer irreversible hypoxic brain damage.
