00:00It is an accusation on the government that everything that happened in the last few months
00:04had the real purpose of establishing a legal bench, a legal court.
00:09Mr. Roopwasan has already said about this a few moments ago,
00:12that we accept that there was no legal court.
00:15There was a legal bench, but there was no court.
00:17The government did what it had to do.
00:19Now, very soon, at any moment, that legal bench will be established
00:23and cases will be closed and it will be easier for the government.
00:27During the hearing of a case, there were such talks.
00:31There was a case in the Supreme Court of Pakistan regarding tax.
00:34During that time, the mention of a legal bench was made.
00:36Justice Mansoor Ali Shah was also present.
00:38Justice Ayesha Malik and Justice Aqeel Abbasi were also present.
00:42In that, Justice Ayesha Sahiba said that this case will be heard by the legal bench.
00:46We are listening to the regular bench because there is a debate now.
00:48So, Mansoor Ali Shah said that at this time, there is no legal bench.
00:51So, is there a non-legal bench? What to do about this?
00:55Until the legal bench is established, are we non-legal?
00:58This means that until the legal bench is established,
01:00legal cases will not be heard.
01:02And then he said that even if we hear this case,
01:04no one can question us.
01:06Now, the question is being raised again and again
01:08whether the case will be heard by the regular bench or the legal bench.
01:10Even if we decide on the case, what will happen?
01:13Even if we decide on the case, who will stop us?
01:16Then there will be a second look at it.
01:18If a second look comes to us, we will say that this was our right.
01:21It was not the right of the legal bench.
01:22Legal cases cannot be heard by the regular bench.
01:24So, this is what happened.
01:26With us is the President of the Supreme Court Bar Association,
01:29Mr. Mian Rauf Atta.
01:31I am very thankful to him.
01:32And the former President of the Supreme Court Bar Association,
01:34Mr. Abid Zubairi.
01:36I am very thankful to both of them.
01:38Mr. Abid, regarding this amendment,
01:40you have announced a formal movement.
01:42And in the recent history of Pakistan,
01:44the last incident of a dictator being shaken
01:47has happened through the legal bench.
01:49And few people are drawing comparisons as well.
01:52But it would not be right to say that
01:54comparisons cannot be made because
01:56there should be no justification to say that
01:58the opinion of the legal bench is clearly divided.
02:00The clear proof of this is that
02:02your opinion is different.
02:04Mr. Atta's opinion is completely different.
02:06He is your opponent.
02:07But he won in the recent elections.
02:09So, we have enough reasons to believe
02:11that the majority of the legal bench is with his opinion.
02:13So, even if the legal bench movement continues,
02:15it will not work like that, Mr. Abid.
02:17Yes, in the name of God, the Merciful, the Compassionate.
02:19Mr. Rahman-e-Rahim, look,
02:21when the legal bench movement was going on,
02:23the government lawyers were present.
02:25Their supporters were also present.
02:27And they were in a very large number.
02:29Look, the legal bench movement,
02:31this movement, these few lawyers,
02:33they are absolutely firm on this point
02:35that this amendment is completely wrong.
02:37And it has completely
02:41subjugated the judiciary
02:43within the Executive and Parliament.
02:45You have seen that,
02:47or the Judicial Commission of Pakistan,
02:49in which you have seen
02:51that most of the judges
02:53have gone to their minority
02:55and their legal bench has been formed.
02:57And the judges who will now head the legal bench,
02:59they themselves voted in their favor
03:01that they become the leaders of the legal bench.
03:03And today, our President,
03:05he has sent me a press statement
03:07in which he himself,
03:09as President,
03:11has praised his legal bench.
03:13So, the UAB has come forward.
03:15But to say that the election was won
03:17and that this amendment was against it,
03:19in this way, the secretary of the other group
03:21has also won with great courage.
03:23So, to say this,
03:25this cannot be said.
03:27Every person has the right to win.
03:29But there are about 4000 lawyers in the Supreme Court.
03:31There are 2-3 lakh lawyers in Pakistan.
03:33So, this movement,
03:35and the people who have challenged it,
03:37this amendment,
03:39now it is up to the court to accept it.
03:41If it is accepted, then naturally
03:43there is funding for all of us.
03:45We will accept it.
03:47But the government does not accept the decisions of the court
03:49that came in the last few days.
03:51So, all these things are in front of you.
03:53Now, obviously, those movements were completely different.
03:55In that, the Chief Justice and the judiciary
03:57were completely released.
03:59And the judges were arrested.
04:01You must remember.
04:03So, a movement arose from that.
04:05Now, these things are not like that.
04:07Here, the whole department,
04:09the parliament and the establishment
04:11have included those judges
04:13who were special.
04:15And especially the last Chief Justice
04:17always used to be on the bench.
04:19So, now people object to this.
04:21Now, as you said today,
04:23an issue arose that which cases will go there
04:25and which will not go.
04:27So, all these things will come out openly now.
04:29Our issue is that the amendment is not right.
04:31We have challenged it.
04:33Now it is up to the court to decide.
04:35Sir, this Ruhwata sir,
04:37like Abid sir gave a reference,
04:39you have explained it
04:41that the matter was settled in 26th.
04:43And these judges,
04:45in your salaries,
04:47in your allowances,
04:49which have increased a lot,
04:51do you think it was a need of the time
04:53or was it a bad thing by the government?
