00:00The Court of Appeal unanimously dismissed the appeals of former PKR Assemblyman Zulkifli

00:06Ibrahim and Dr. Afif Bahardin, challenging their 2023 removal from the Penang State Assembly.

00:13Justice Che Muhammad Ruzima Ghazali, leading the panel, said the High Court had comprehensively

00:18addressed all arguments and found no errors in its reasoning.

00:22Ruzima said the decision of the High Court, which ruled that the two were correctly disqualified

00:27due to their expulsion from PKR, was fully endorsed.

00:31On December 8 last year, Justice Anand Ponadure ruled that Zulkifli and Afif were rightfully

00:36disqualified from the Penang State Assembly after being expelled from PKR, while Kalik

00:41Mehtab Ishak and Zulkifli Lazim Fabersatu kept their seats as the anti-hopping law didn't

00:46apply to them.

00:48The disqualification motion was introduced in February last year by then-Deputy Chief

00:52Minister Ahmad Zakiuddin under Penang's 2012 anti-hopping law.

00:57Zulkifli and Afif's lawyer Azhar Harun argued that Penang's Article 14a conflicted with

01:02the federal constitution's Article 49a, which does not remove MPs for party expulsions.

01:09However, the federal court had in 2022 upheld Article 14a's constitutionality and the legislature

01:16decided on the disqualifications.
