00:00In Limitation Act, we all have heard the word named as Condemnation of delay. So
00:06in the Limitation Act, we are talking about Condemnation of delay. So what is
00:15Condemnation of delay? So in this video, we're going to discuss about this in
00:20detail. So Condemnation of delay means that if there is a time period fixed
00:25time period fixed for any kind of a case. Okay, so there's a time period fixed for
00:32any case and you have to go to court and ask the court to file your case or if
00:41you're trying to go for appeal and if you want to file an appeal and the time
00:46period is passed, your appeal may be dismissed. Suppose if you have to appeal
00:53within 30 days. This is the time period fixed and you did not appeal in the
00:58given time and you're going to court after 44 days and you're saying that I
01:04wanted to appeal now but but the courts will say that the time was 33, 30 days
01:11and now you have visited court in the 44th day. Why should we give you a
01:18chance to apply the appeal? So at that point, you have to go to court and give
01:25an application and in this application, you will tell the courts to give you a
01:30chance to give the appeal after the time passed. At that point, court will set a
01:37meeting in which court judges will be present on the court, sorry in the court
01:43and you will also be present there and they will ask you the reason of delays.
01:49So in these 44 days, you will tell every day like suppose in the first day what
01:55you did, in the second day where you were and what you did, in the third day where
02:00you were and what you did. So the same way it will continue to 44 days. So if
02:04the court judges think that your 44 days delays are reasonable like how
02:12these delays can be reasonable. The delays can be reasonable if you are sick
02:18or ill and if you're sick or ill and you are not able to go to court and at that
02:25point, court will think yes your delay are reasonable. Other than this, if you
02:31are in jail and you have been in jail for like 50 days or maybe 3 months or
02:38anything like that, you can also ask the court that I was in jail and I cannot
02:44visit the court. So at that time, your delays are reasonable. So if your delays
02:50are reasonable enough that the courts are satisfied with your delays
02:56and that point, courts will grant you an option to apply for the appeal even if
03:02the delay is extended. Suppose appeal should be on 30 days but you have
03:08delayed it and you're filing it after 44 days. So if your reasons are accurate and
03:14reasonable, the court will accept your appeal and will tell you to appeal even
03:19after the time period is passed. So this all thing is called as condemnation of
