Special counsel Jack Smith urged the Supreme Court to reject Donald Trump's claim of presidential immunity in the federal 2020 election interference case. In a 66-page filing, Smith argued Trump's "novel and sweeping" immunity claim counters the "bedrock principle" that "no person is above the law— including the President.” Smith stated the Founders never endorsed criminal immunity for former presidents based on historical precedent. He called Trump's interpretation that statutes must expressly name the president "radical" and that it would free presidents from virtually all criminal law.
