Speaking before the Public Petitions Committee, Interior Cabinet Secretary Kithure Kindiki has revealed that the government has reached out to TikTok, expressing dissatisfaction with their compliance with Kenyan laws. https://shorturl.at/fnvyK

00:00 We as government also, through the office of the Data Protection Commissioner, have
00:10 contacted TikTok.
00:13 The government of Kenya is in contact with TikTok, and we have raised concerns relating
00:24 to the way TikTok is processing their data-related activities.
00:33 In particular, the government of Kenya has requested from the owners and operators of
00:40 TikTok to provide to us the levels of compliance with our laws, namely the Data Protection
00:55 Act and the Data Protection Regulations.
00:59 We have also asked them to explain to us the measures that they are taking or they intend
01:10 to take to ensure the privacy of individuals is respected in accordance with the laws of
01:18 our country.
01:19 At the moment, we are not satisfied that there is compliance.
01:25 We are waiting for the explanation from TikTok.
01:30 We as government have also requested or required TikTok to demonstrate to us their compliance
01:40 with the requirements of all the laws of Kenya relating to data protection.
01:48 We have also required them to provide details of the effectiveness of age verification and
02:01 content filtering procedures.
02:05 We have also asked them to tell us what they are doing to implement Kenya-specific supplemental
02:31 terms in the privacy policy considering the provisions of our laws.
02:37 In other words, we have asked them how they are customizing their data processing in the
02:45 TikTok platform to comply with the law of our country.
02:55 The government has also required TikTok to demonstrate full compliance and it's only
03:07 after that demonstration that we'll also require them to register with the Office of Data Commissioner
03:16 of the Republic of Kenya as data controllers and data processors going forward.
