00:00 Alright, moving on over to Housewives news, it's our Housewives legal story of the week.
00:05 So according to paperwork obtained by Us Weekly, Real Housewives of Salt Lake City star Heather
00:09 Gay and Monica Garcia have been in an ongoing legal battle since August, with Monica alleging
00:15 that she got botched cosmetic procedures from Heather's beauty lab and laser company.
00:19 So beauty lab and laser company initially sued Monica for breach of contract and breach
00:25 of the covenant of good faith and fair dealing after she allegedly failed to pay about $2,500
00:32 for past cosmetic procedures despite signing a contract in December of 2019.
00:37 They indicate that Monica paid the initial $449 but failed to complete her remaining
00:42 monthly payments.
00:43 Beauty Lab alleged that the business suffered and continues to suffer significant losses
00:48 and damages because of Monica's lack of payment.
00:51 The company is seeking not less than $2,000.
00:54 So she went on to file a countersuit in September but it was amended on November 7th.
00:58 She claimed that she received defective negligence given injections which did not have the intended
01:05 promised result which is why she failed to make payments.
01:08 Heather said this lawsuit has zero merit and unfortunately is a pattern of behavior from
01:12 a desperate woman who when unable to pay her bills, lashes out to avoid accountability.
01:17 So does this lawsuit have any merit?
01:19 Oh those housewives, Christina.
01:22 Now they're suing each other.
01:24 So, you know, it started with a breach of contract case, right?
01:28 Heather says Monica owes her about $2,000 in unpaid medical bills and then Monica countersuits
01:36 alleging medical negligence.
01:38 I think I'm probably going to have to side with Heather on this one and this is why.
01:43 Regardless of what type of medical procedure you have, injections, filler, Botox, usually
01:48 there's some informed consent.
01:50 You discuss the risks with your doctor or your medical practitioner and you agree to
01:56 proceed notwithstanding the risks.
01:59 We all know that cosmetic surgery and different types of injections, they're not guaranteed
02:04 and I bet you there is an agreement and there's some fine print where Monica acknowledged
02:08 all this and I think she's still going to be on the hook for paying the medical bills
02:12 that she owes.
02:13 Right.
02:14 So they're seeking damages not less than $2,000.
02:17 So will she have to pay like interest on some of these payments at this point as well?
02:22 Because she owes about $2,000 left in what she owes, but is she going to have to pay
02:26 even more for this?
02:28 Potentially yes.
02:29 This is one of those areas where the contract is going to control.
02:32 Let's say there's an interest provision or potentially even an attorney fees provision
02:36 to enforce the agreement or to go after any unpaid medical bills.
02:42 Monica may be on the hook for even more than the $2,000 if there's a specific provision
02:47 in their agreement that calls for it.
02:49 Right.
02:50 If she can prove that she had these botched injections and things like that, does that
02:54 change anything or is a contract a contract and you have to pay for it?
02:58 Well, it would be with the offset.
03:00 So she would still potentially owe the $2,000 unless she can say that the medical provider
03:05 breached.
03:06 But if she can't prove medical negligence, her claim is going to be worth a lot more
03:10 than $2,000.
03:11 Botched medical procedures on your face, they can be worth tens, hundreds of thousands,
03:17 maybe even millions of dollars if it can affect her career going forward.
03:21 So again, pretty tough legal hurdle to overcome.
03:26 But if she does get there and does prove medical negligence, medical malpractice, then her
03:31 case is going to be worth a lot more than $2,000.
